1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) DEFAULT ORDER OF 5 Teaching License of ) REVOCATION OF 6 FRANK WALTER RENNER ) RIGHT TO APPLY 7 8 , 9 On June 4, 2010, the Teacher Standards and Practices Commission 10 (Commission) issued a Notice of Opportunity for Hearing to Frank Walter Renner 11 (Renner) in which the Commission charged him with Gross Neglect of Duty pursuant to 12 OAR 584-020-0010(5), OAR 584-020-0040(4)(c), OAR 584-020-0035(1)(b), OAR 584- 13 020-0035(1)(c)(A), OAR 584-020-0035(1)(c)(B), OAR 584-020-0035(1)(c)(C), OAR 584- 14 020-0035(1)(c)(D), OAR 584-020-0040(4)(f), and OAR 584-020-0040(5)(c). The Notice 15 was sent via U.S. First Class Mail and U.S. Certified Mail Receipt 7009 1410 0002 1902 16 5290 to the address on file with the Commission. The U.S. Postal Service returned the 17 certified mail to the Commission on June 24, 2010 as unclaimed. The first class mail 18 was not returned to the Commission, however, indicating that the address on file with 19 the Commission was correct. The Notice of Opportunity of Hearing, dated June 4, 20 2010, and signed by Victoria Chamberlain, Executive Director, stated: 21 “If a request for hearing is not received within this 21 day period, your right to a 22 hearing shall be considered waived unless your failure to request a hearing was 23 beyond your reasonable control. lf you do not request a hearing or if you fail to 24 appear at a hearing, the Commission will adopt an order 0f default which may 25 include the revocation or suspension of your license or other discipline.“ 26 , 27 Mr. Renner did not request a hearing. The Commission, therefore, finds Mr. Renner to 28 be in default and enters the following findings of fact, conclusions of law and order, 29 based on the files and records of the Commission concerning this matter. 30 // / PAGE 1-DEFAULT ORDER OF REVOCATION OF RIGHT TO APPLY - RENNER, FRANK WALTER 1 FINDINGS OF FACT 2 1. The Commission has licensed Mr. Renner as a teacher in Oregon since August 7, 2007. 3 His Initial Teaching License, issued on August 7, 2007, expired on February 7, 2009. 4 His Emergency Teaching License, issued February 8, 2009, expired on June 30, 2009. 5 During all relevant times, Mr. Renner was employed by the Klamath Falls City School 6 District. 7 2. On May 11, 2009, Mr. Renner was arrested on charges of Official Misconduct and Sex 8 Abuse in the 3rd Degree. On May 11, 2009, he was convicted of Official Misconduct, a 9 class A Misdemeanor. The conduct that gave rise to these charges and conviction was 10 Mr. Renner's inappropriate relationship with a female student. Specifically Mr. Renner 11 gave personal gifts to the female student, such as a bracelet, and exchanged text 12 messages. Mr. Renner also drove the student in his personal vehicle to lunches, where 13 on certain occasions he engaged in kissing and intimate touching of the student. Mr. 14 Renner did not report to his superiors the feelings that the student had for him. As a 15 condition of his conviction for Official Misconduct, the Klamath County Circuit Court 16 ordered Mr. Renner to surrender his teaching license. , 17 CONCLUSIONS OF LAW 18 Frank Walter Renner‘s above described conduct constitutes gross neglect of duty 19 in violation of ORS 342.175(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR 584' 20 020-0010(5) (Use professional judgment), OAR 584-020-0040(4)(c) (Knowing 21 falsification of any document or knowing misrepresentation directly related to licensure, 22 employment, or professional duties), OAR 584-020-0040(4)(o) as it incorporates OAR 23 584-020-0035(1)(b) (Refrain from exploiting professional relationships with any student 24 for personal gain, 0r in support of persons or issues), OAR 584-020-0035(1)(c)(A) (Not 25 demonstrating or expressing professionally inappropriate interest in a student's personal 26 life), OAR 584-020-0035(1)(c)(B) (Not accepting 0r giving or exchanging romantic or 27 overly personal gifts or notes with a student), OAR 584-020-0035(1)(c)(C) (Reporting to 28 the educator's supervisor if the educator has reason to believe a student is or may be 29 becoming romantically attached to the educator), OAR 584-020-0035(1)(c)(D) 30 (Honoring appropriate adult boundaries with students in conduct and conversations at PAGE 2-DEFAULT ORDER OF REVOCATION OF RIGHT TO APPLY - RENNER, FRANK WALTER 1 all times), and OAR 584020-0040(4)(f) (Any sexual- conduct with a student). Frank 2 Renners conviction for Official Misconduct constitutes gross unfitness in violation of 3 OAR 584-020-0040(5)(c) (Conviction of violating any federal, state, or local law. A 4 conviction includes any final judgment of conviction by a court whether as the result of 5 guilty plea, no contest plea or any other means).
