1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS AND 4 Teaching License of ) FINAL ORDER OF SUSPENSION g MICHAEL CORNELIUS WILLIAMS ) 7 On October 20, 2009 the Commission received a report from the Superintendent 8 of the North Wasco School District, indicating that Michael Cornelius Williams 9 (Williams) had an altercation with a student during a football practice. 1 0 After review of the matters alleged, Williams and the Commission agree that their 1 1 respective interests, together with the public interest, are best served by a stipulation to 12 certain facts and the imposition of a 30 day suspension of his license. Williams 13 stipulates that there is sufficient information contained in the Commission’s files t0 14 support the stipulation of facts set forth below. 15 By signing below, Williams acknowledges, understands, stipulates, and agrees to 16 the following: (i) he has been fully advised of his rights to notice and a hearing to contest 17 the findings of fact, conclusions 0f law, and order set forth below, and fully and finally 18 waives all such rights and any rights t0 appeal or otherwise challenge this Stipulation of 19 Facts and Final Order of Suspension (Stipulation and Final Order); (ii) this Stipulation 20 and Final Order is a public document and disclosed to the public upon request by the 21 Commission; (iii) this Stipulation and Final Order is contingent upon and subject to 22 approval and adoption by the Commission. If the Commission does not approve and 23 adopt this Stipulation and Final Order, then neither Williams nor the Commission are 24 bound by the terms herein; (iv) he has fully read this Stipulation and Final Order, and 25 understands it completely; (v) he voluntarily, without any force or duress, enters into 26 this Stipulation and Final Order and consents to issuance and entry of the Stipulated 27 Final Order below; (vi) he states that no promise or representation has been made to 28 induce him to sign this Stipulation and Final Order; and (vii) he has consulted with an 29 attorney regarding this Stipulation and Final Order and has been fully advised with 3O regard to his rights thereto, or waives any and all rights to consult with an attorney prior 31 to entering into this Stipulation and Final Order and issuance and entry of the Stipulated 32 Final Order below. 33 / / / 34 / / / 35 / / / 36 / / / Page 1 STIPULATION OF FACTS AND ORDER OF SUSPENSION —WILLIAMS, MICHAEL CORNELIUS 1 STIPULATION OF FACTS 2 1. The Commission has licensed Michael Cornelius Williams as a teacher in Oregon 3 since September 5, 2007. Williams’ current Initial I Teaching License, with an 4 endorsement in Physical Education (ML/ HS, ECE/ELE) issued on March 6, 2009, is 5 valid until August 4, 2011. During all relevant times, Cornelius was employed by the 6 North Wasco County School District. 7 2. On September 22, 2009, Williams, a coach, was present at football practice. The 8 students were asked to stand while listening to another coach speak. Student RT did 9 not stand when asked. Williams pushed student RT to the ground for failing to follow , 1 O the instruction to stand. 1 1 3. This conduct constitutes gross neglect of duty in violation of OAR 584— 25 020-0040(4)(n) as it incorporates OAR 584-ozo~ooio(1) (Recognize the worth and 26 dignity of all persons and respect for each individual), OAR 584-020-0010(5) (Use 27 professional judgment), OAR 584-020-0020(2)(d) (Skill in the supervision of students); 28 and OAR 584-020-0040(4)(d) (Unreasonable physical force against students, fellow 29 employees, or visitors to the school, except as permitted under ORS 339.250). 3O When interviewed about this matter Cornelius was not truthful concerning his 31 conduct.
