g On May 31, 2011, the Commission referred Jamie Laura Ledgerwood
8 (Ledgerwood) to investigation for violation of professional practices standards.
9 After review of the matters alleged, Ledgerwood and the Commission agree that
1 0 their respective interests, together with the public interest, are best served by a
1 1 stipulation to certain facts and the imposition of a period of probation.
12 By signing below, Ledgerwood acknowledges, understands, stipulates, and agrees
13 to the following: (i) she has been fully advised of her rights to notice and a hearing to
14 contest the findings of fact, conclusions of law, and order set forth below, and fully and
15 finally waives all such rights and any rights to appeal or otherwise challenge this
16 Stipulation of Facts and Final Order Of Reprimand and Probation (Stipulation and Final
17 Order); (ii) this Stipulation and Final Order is a public document and disclosed to the
18 public upon request by the Commission; (iii) this Stipulation and Final Order is
19 contingent upon and subject to approval and adoption by the Commission. If the
20 Commission does not approve and adopt this Stipulation and Final Order, then neither
21 Ledgerwood nor the Commission are bound by the terms herein; (iv) she has fully read
22 this Stipulation and Final Order, and understands it completely; (v) she voluntarily,
23 without any force or duress, enters into this Stipulation and Final Order and consents to
24 issuance and entry Of the Stipulated Final Order below; (vi) she states that no promise or
25 representation has been made to induce her to sign this Stipulation and Final Order; and
26 (vii) she has consulted with an attorney regarding this Stipulation and Final Order and
27 has been fully advised with regard to her rights thereto, or waives any and all rights to
28 consult with an attorney prior to entering into this Stipulation and Final Order and
29 issuance and entry of the Stipulated Final Order below.
30 STIPULATION OF FACTS
31 1. Jamie Laura Ledgerwood has been licensed by the Commission since February 8, 2008.
32 Ledgerwood currently holds an Initial I Teaching License with an endorsement in
33 Multiple Subjects Self-Contained (ECE, ELE); issued May 16, 2011, and scheduled to
34 expire on May 15, 2014. During all relevant times, Ledgerwood was not employed by any
35 School District.

1 2. On May 16, 2011, the Commission received Ledgerwood’s application for renewal of her
2 Initial I Teaching License. Ledgerwood answered character question number 8, as “Yes” ;
3 indicating she had been convicted, granted a diversion or conditional discharge by a
4 court for any; Felony, Misdemeanor, or Major Traffic offence. Ledgerwood explained
5 her answer indicating she had been arrested for shoplifting on November 21, 2008.
6 Ledgerwood was Offered a diversion agreement by the courts. Ledgerwood failed to
7 complete her diversion program because she was arrested for shoplifting again on
8 January 29, 2009. As a result, Ledgerwood was convicted of two separate counts Of Theft
9 II, a misdemeanor.

1O 3. Ledgerwood has sought and successfully completed related treatment and counseling.

1 1 Ledgerwood has had no other related incidents since her treatment.

22 CONCLUSION OF LAW

23 Jamie Laura Ledgerwood was convicted of two separate counts 0f Theft II

24 (shoplifting), a misdemeanor. This conduct constitutes gross neglect of duty in violation

25 of ORS 342.175 (1)(b); OAR 584-020-oo4o(4)(n) as it incorporates OAR 584-020-

26 0010(5) (Use professional judgment). This conduct also constitutes gross unfitness in

27 violation of ORS 342.175(1)(c); OAR 584-o2o-Oo4o(5)(c) (Conviction of violating any

28 federal, state, or local law. A conviction includes any final judgment 0f conviction by a

29 court whether as the result of guilty plea, no contest plea or any other means).

3O The Commission’s authority to impose discipline in this matter is based upon

31 ORS 342.175.

1 ORDER

2 The Commission adopts and incorporates herein the above findings of fact and

3 conclusions of law, and based thereon, imposes a period of probation on Jamie Laura

4 Ledgerwood’s Initial I Teaching License as detailed below.

5 The Commission imposes a two (2) year probation upon Ledgerwood to

6 commence upon finalization of this order subject to the following terms and conditions

7 of probation:

8 1. Ledgerwood shall comply with the Standards for Competent and Ethical

9 Performance of Oregon Educators under Oregon Administrative Rules Chapter
10 584, Division 020.
1 1 2. Ledgerwood will Obey all laws and ordinances.
12 Violation of any term 0r condition of probation shall constitute an independent basis for
13 the Commission to otherwise impose discipline, up to and including revocation Of
14 Ledgerwood’ teaching license, after first providing Ledgerwood with notice and
1 5 opportunity for hearing.
