The Notice I? was sent via U.S. First Class Mail and U.S. Certified Mail Receipt 7012 1010 0003 2804 I ‘> 4647 to the address on file with the Commission. The Notice designated the Commission file I I as the record for purposes of proving a prima facie case. The Certified Mail receipt was l 5 returned to the Commission “signed” on September 11, 2014. The first class mail was not 16 returned to the Commission. The Notice of Opportunity of Hearing, dated September 5, 1 7 2014, and signed by Victoria Chamberlain, Executive Director, stated: l 8 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY l9 PERIOD, YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED '10 UNLESS YOUR FAILURE TO REQUEST A HEARING WAS BEYOND YOUR 11 REASONABLE CONTROL. IF YOU DO NOT REQUEST A HEARING OR IF YOU 12 FAIL TO APPEAR AT A HEARING, THE COMMISSION WILL ADOPT AN ORDER 23 OF DEFAULT WHICH MAY INCLUDE THE REVOCATION OR SUSPENSION OF Z4 YOUR LICENSE OR OTHER DISCIPLINE.” :5 16 Callaway did not requested a hearing. The Commission, therefore, finds Callaway to be in 2 7 default and enters the following findings of fact, conclusions of law, and final order, based 28 on the files and records of the Commission concerning this matter. I) FINDINGS OF FACT 30 1. Callaway has been licensed by the Commission since October 31, 2007. Callaway’s 3 1 Initial II Teaching License, with endorsements in Middle School Social Studies (ML), .IZ Multiple Subjects (MIDLVL), and Multiple Subjects Self-Contained (ECE, ELE), was 33 issued on June 26, 2014, and expires on June 25, 2017. Callaway’s Initial H Administrator License with an endorsement in Administrator (ALL LVL), was issued 35 0n November 11, 2010, and expired on June 25, 2014. During all relevant times, Callaway was employed by 2 the Glide School District. “a 4 2. On January 21, 2014, the Commission received a report from the Glide School 5 District indicating Callaway violated professional standards by falsely certifying o teacher OAKS training. District and Commission investigations determined that 7 during the 2013-2014 school year, Callaway failed to properly train and certify S district educators in OAKS testing protocol as mandated. Callaway stated that t) because she was busy with other duties, Callaway was unable to properly certify all I F) the teachers. Callaway requested that some teachers sign the OAKS “Test I l Administrator Assurance of Test Security” forms certifying they had “received test I 2 administration and security training for the current school year” even though they I 3 had not received the required training. 14 CONCLUSIONS OF LAW ‘ I 5 Joanne Eileen Callaway engaged in unprofessional conduct as described above.
