1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION , 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS AND 4 Teaching License 0f ) FINAL ORDER OF REPRIMAND g JONATHAN ROBERT LUEBKE ) 7 On June 1, 2011, the Commission referred Jonathan Robert Luebke (Luebke), to 8 investigation for teaching without a License or Charter School Registry. 9 After review of the matters alleged, Luebke and the Commission agree that their 1 O respective interests, together with the public interest, are best served by a stipulation to 1 1 certain facts and the imposition of a public reprimand. 12 By signing below, Luebke acknowledges, understands, stipulates, and agrees t0 1 3 the following: (i) he has been fully advised of his rights to notice and a hearing to contest 14 the findings of fact, conclusions of law, and order set forth below, and fully and finally 15 waives all such rights and any rights to appeal 0r otherwise challenge this Stipulation of 16 Facts and Final Order 0f Reprimand (Stipulation and Final Order); (ii) this Stipulation 17 and Final Order is a public document and disclosed to the public upon request by the 18 Commission; (iii) this Stipulation and Final Order is contingent upon and subject to 19 approval and adoption by the Commission. If the Commission does not approve and 20 adopt this Stipulation and Final Order, then neither Luebke nor the Commission are 21 bound by the terms herein; (iv) he has fully read this Stipulation and Final Order, and 22 understands it completely; (v) he voluntarily, without any force or duress, enters into 23 this Stipulation and Final Order and consents to issuance and entry of the Stipulated 24 Final Order below; (vi) he states that no promise 0r representation has been made t0 25 induce him to sign this Stipulation and Final Order; and (vii) he has consulted with an 26 attorney regarding this Stipulation and Final Order and has been fully advised with 27 regard to his rights thereto, or waives any and all rights t0 consult with an attorney prior 28 to entering into this Stipulation and Final Order and issuance and entry of the Stipulated 29 Final Order below. 30 / / / 31 STIPULATION OF FACTS 32 1. Jonathan Robert Luebke has been licensed by the Commission since October 15, 2008. 33 Luebke currently holds an Initial I Teaching License, with an endorsement in Multiple 34 Subjects (MIDLVL) and Social Studies (HS, ML); issued June 1, 2011, and valid through 35 January 15, 2015. During all relevant times, Luebke was employed by the Arthur 36 Academy within the David Douglas School District. Page 1 STIPULATION OF FACTS AND ORDER OF REPRIMAND - LUEBKE, JONATHAN ROBERT 1 2. On March 2, 2011, the Commission received Luebke’s application for reinstatement of 2 his expired Initial I Teaching License. According to Commission records, Luebke‘s Initial 3 I Teaching License had expired 0n April 15, 2010. The Commission learned from 4 Luebke’s reinstatement application and the Arthur Academy’s submitted Professional 5 Educational Experience Report (PEER) form that Luebke had been teaching third grade, 6 Multiple Subjects Self Contained, at the Arthur Academy Charter School and had been so 7 employed since 2008. 8 3.‘ The Commission’s investigation determined that Luebke worked as a teacher, without 9 either a valid license or registration from April 15, 2010, when his Initial Teaching 10 License expired, until the Arthur Academy administration removed him from the 1 1 classroom on or about May 25, 2011, when the administration realized Luebkc’s license 12 had expired. As a result, Luebke taught without a valid license for a period of 13 approximately thirteen (13) months. 14 4. Luebke has acknowledged his error in allowing his license to lapse and TSPC 1 5 acknowledges that Luebke has worked with Commission staff to reach a reasonable 16 resolution 0f this matter with the least burden possible for both parties. 17 / / / 18 IT IS .so STIPULATED; . . / j/V I f 19 /4// z.
