1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS AND 4 Charter School Registration of ) FINAL ORDER OF SUSPENSION g MARJAN ANTOINETTE ROTTING ) 7 On or about December 18, 2009, the Teacher Standards and Practices 8 Commission (Commission), referred Marjan Antoinette Rotting (Rotting) for 9 investigation following receipt of application materials indicating that she worked in a 1Q charter school without the proper license/ registration. 1 1 After review of the matters alleged, Rotting and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to 13 certain facts and the imposition of a 30 day suspension. 14 By signing below, Rotting acknowledges, understands, stipulates, and agrees to 15 the following: (i) she has been fully advised of her rights to notice and a hearing to 16 contest the findings of fact, conclusions of law, and order set forth below, and fully and 17 finally waives all such rights and any rights to appeal or otherwise challenge this 18 Stipulation of Facts and Final Order of Suspension (Stipulation and Final Order); (ii) this 19 Stipulation and Final Order is a public document and disclosed to the public upon , 2O request by the Commission; (iii) this Stipulation and Final Order is contingent upon and 21 subject to approval and adoption by the Commission. If the Commission does not 22 approve and adopt this Stipulation and Final Order, then neither Rotting nor the 23 Commission are bound by the terms herein; (iv) she has fully read this Stipulation and 24 Final Order, and understands it completely; (v) she voluntarily, without any force or 25 duress, enters into this Stipulation and Final Order and consents t0 issuance and entry of 26 the Stipulated Final Order below; (vi) she states that no promise or representation has 27 been made to induce her to sign this Stipulation and Final Order; and (vii) she has 28 consulted with an attorney regarding this Stipulation and Final Order and has been fully 29 advised with regard to her rights thereto, or waives any and all rights to consult with an 3O attorney prior to entering into this Stipulation and Final Order and issuance and entry of 31 the Stipulated Final Order below. 32 / / / 33 / / / 34 / / / 35 / / / Page 1 STIPULATION OF FACTS AND ORDER OF SUSPENSION- ROTTING, MARJAN 1 STIPULATION OF FACTS 2 1. The Commission has licensed Rotting since November 24, 2009. Rotting’s 3 current Charter School Registry, with an endorsement in Integrated Science, 4 issued on November 24, 2009, is valid until November 24, 2012. During all 5 relevant times, Rotting was employed by the Ace Academy. 6 2. On August 11, 2008, the Commission received R0tting’s first application for 7 Charter School Registration. Rotting believed that the fingerprints she had 8 submitted to Portland Public Schools in order to teach summer school were on 9 file with the Commission and therefore did not submit additional fingerprints 10 with her August 2008 application. The Commission informed Rotting that her 1 1 application was incomplete due to lack of fingerprints. 12 3. On April 27, 2010, Rotting wrote a letter to the Commission indicating that she 13 did receive the notification| that her application was incomplete. Rotting further ' 14 indicated that she sent the requested materials sometime in January of 2009. 1 5 The office assistant at ACE Academy confirmed that she sent the materials to the 16 Commission in January, 2009. The Commission has no record of receiving the 17 requested materials during the 2008-2009 school year. _ 18 4. In September of 2009 the Commission informed Rotting and Ace Academy that 19 Rotting was not in compliance with licensure rules. On November 10, 2009, 20 TSPC received a letter from Michael Taylor, Director of Ace Academy, regarding 21 R0tting’s failure to hold proper licensure. 22 5. This conduct constitutes gross neglect of duty in 4 violation of ORS 342.175(1)(b); OAR 584-o2o-oo4o(4)(n) as it incorporates OAR 584- 5 020-0010(5) (Use professional judgment); and OAR 584-020-0040(4)(r) (Knowingly 6 working without a license). 7 The Commission’s authority to impose discipline in this matter is based upon 8 ORS 342.175, and OAR 584-050-000030(1) (TSPC may deny a license if a person has 9 served in violation of licensure assignment. Such denial shall extend either for one year 1O from the date of application for licensure or for a period equal to the time served 1 1 without licensure, whichever is less.
