5 KYLE ROBERT TEMPLE ) PUBLIC REPRIMAND
g On or about April 15, 2014, the Teacher Standards and Practices Commission
8 (Commission) received a report from the North Santiam School District indicating that
9 Kyle Temple (Temple) had violated professional standards.
1O After review of the matters alleged, Temple and the Commission agree that their
i 1 1 respective interests, together with the public interest, are best served by a stipulation to
12 certain facts, and the imposition of a Public Reprimand.
1 3 By signing below, Temple acknowledges, understands, stipulates, and agrees to
14 the following: (i) he has been fully advised of his rights to notice and a hearing t0 contest
15 the findings of fact, conclusions of law, and order set forth below, and fully and finally
1 16 waives all such rights and any rights to appeal or otherwise challenge this Stipulation of
17 Facts and Final Order of Public Reprimand (Stipulation and Final Order); (ii) this
18 Stipulation and Final Order is a public document and disclosed to the public upon
l 19 request by the Commission; (iii) this Stipulation and Final Order is contingent upon and
20 subject to approval and adoption by the Commission. If the Commission does not
21 approve and adopt this Stipulation and Final Order, then neither Temple nor the
22 Commission are bound by the terms herein; (iv) he has fully read this Stipulation and
23 Final Order, and understands it completely; (v) he voluntarily, without any force 0r
24 duress, enters into this Stipulation and Final Order and consents to issuance and entry of
25 the Stipulated Final Order below; (vi) he states that no promise or representation has
26 been made to induce him to sign this Stipulation and Final Order; and (vii) he has
27 consulted with an attorney regarding this Stipulation and Final Order and has been fully
28 advised with regard to his rights thereto, or waives any and all rights to consult with an
29 attorney prior to entering into this Stipulation and Final Order and issuance and entry of
30 the Stipulated Final Order below.
31 STIPULATION OF FACTS
32 1. The Commission has licensed Kyle Robert Temple since December 6, 2008.
33 Temple’s current Initial I Teaching License with endorsements in Multiple
34 Subjects (MIDLVL) and Social Studies (HS, ML), was issued on June 20, 2014,

1 and expires 0n June 19, 2017. During all relevant times, Temple was employed
2 by the North Santiam School District.
3 2. On or about February 27, 2014, Temple coached and chaperoned a school
4 sponsored, State Wrestling Tournament in Portland, Oregon where Temple
5 supervised student athletes. Investigation determined, and by Temple’s own
6 admission, Temple occasionally consumed alcoholic beverages (beer) at a meal,
7 at a social gathering, and in a hotel room while Temple remained on duty as
8 chaperone and school representative responsible for student athletes. It was
9 further determined that Temple observed nineteen year old, volunteer coach
‘ 1O Redman consume alcohol during the event. While Temple may not have known
1 1 Redman’s age, Temple was responsible for the coaching staff and failed to
12 confirm Redman was of legal drinking age.

22 CONCLUSION OF LAW
23 On or about February 27, 2014, Temple violated professional standards as
24 described above. This conduct constitutes gross neglect of duty in violation of ORS
25 342.175(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR 584-020-oo1o(5) (Use
26 professional judgment), OAR 584-020-0020(2)(d) (Skill in the supervision of students);
27 and OAR 584-020-0040(4)(g) (Appearing on duty or at any dish'ict—sponsored activity
28 while under the influence of alcohol or any controlled substance).

31 ORS 342.175.

2 The Commission hereby adopts and incorporates herein the above findings of fact,
3 conclusions of law, and based thereon hereby imposes a public reprimand upon Temple’s
4 educators license.
