If the Commission does not 20 approve and adopt this Stipulation and Final Order, then neither Massinger nor the 21 Commission are bound by the terms herein; (iv) he has fully read this Stipulation and 22 Final Order, and understands it completely; (v) he voluntarily, without any force or 23 duress, enters into this Stipulation and Final Order and consents to issuance and entry of 24 the Stipulated Final Ordcr below; (vi) he states that no promise or representation has 25 been made to induce him to sign this Stipulation and Final Order; and (vii) he has 26 consulted with an attorney regarding this Stipulation and Final Order and has been fully 27 advised with regard to his rights thereto, or waives any and all rights t0 consult with an 28 attorney prior to entering into this Stipulation and Final Order and issuance and entry of 29 the Stipulated Final Order below. 3O STIPULATION OF FACTS 31 1. Jordan Kyle Massinger has held a Charter School Registry since August 25, 2009. 32 Massinger’s current Charter School Registry issued on August 25, 2009, expires 0n 33 August 25, 2012. During all relevant times Massigner was employed by the Arthur 34 Academy Public Charter School 35 2. On November 28, 2008, the Commission received Massigner’s application for a Charter 36 School Registry. Page 1 STIPULATION OF FACTS AND ORDER OF SUSPENSION — MASSINGER, JORDAN KYLE 1 a. On December 26, 2008, the Commission sent an incomplete notice to Massinger 2 and Arthur Academy requesting a fingerprint card for criminal history 3 verification. 4 b. On April 13, 2009, the requested fingerprint card was received by the 5 Commission. 6 c. On April 30, 2009, the Commission sent Massinger a new incomplete notice, 7 requested a new letter from Arthur Academy requesting registry for Massinger, 8 and a letter of explanation whether Massinger was employed prior to receiving 9 his Charter School Registry. 1O d. On May 29, 2009, the Commission sent another incomplete notice to Massinger 1 1 and Arthur Academy requesting the same information. 12 e. On June 19, 2009, the Commission received a letter from Arthur Academy 1 3 indicating that Massinger had been hired to teach 4‘h grade at the school and 14 requesting Massinger’s registry. 15 f. On August 17, 2009, the Commission sent Massinger and Arthur Academy 16 another incomplete notice, again requesting a new letter requesting the registry 1 7 and explaining why Massinger was allowed to teach without a registry. 18 g. On August 20, 2009, the Commission received a letter from Arthur Academy 1 9 indicating that Massinger had taught at the charter school beginning in the 20 2008/2009 school year and would be teaching the following year. 21 h. On December 22, 2009, the Commission received a phone call from the Arthur 22 Academy requesting Massinger’s registry and explaining problems with Office 23 staff that led to delays in properly responding. 24 3. Massinger’s Charter School Registry was issued in December of 2009, effective the 25 beginning of the 2009/ 2010 school year.
