l BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) DEFAULT ORDER 5 Teaching License of ) OF 6 MOLLYANN MURPHY ) SUSPENSION 7 8 On July 12, 2011, the Teacher Standards and Practices Commission (Commission) issued 9 a Notice of Opportunity for Hearing to Molly Ann Murphy (Murphy) in which the Commission 10 charged her with Gross Neglect of Duty pursuant t0 ORS 342.175(1)(b); OAR 584-020- 11 oo4o(4)(n), OAR 584-o2o-oo1o(5) and OAR 584-020-004o(4)(j). The Notice was sent via U.S. 12 First Class Mail and U.S. Certified Mail Receipt 7010 022780 oooo 2187 6768 to the address on 13 file with the Commission. The certified mail was returned to the Commission as unclaimed. 14 The regular mail was not returned and is assumed delivered. The Notice of Opportunity of 15 Hearing, dated July 12, 2011, and signed by Victoria Chamberlain, Executive Director, stated: 16 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY PERIOD, l7 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR 18 FAILURE TO REQUEST A HEARING WAS BEYOND YOUR REASONABLE CONTROL. l9 IF YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR AT A 2O HEARING, THE COMMISSION WILL ADOPT AN ORDER OF DEFAULT WHICH MAY 21 INCLUDE THE REVOCATION OR SUSPENSION OF YOUR LICENSE OR OTHER 22 DISCIPLINE.” 23 24 Murphy did not request a hearing. The Commission, therefore, finds Murphy to be in default 25 and enters the following findings of fact, conclusions of law and order, based on the files and 26 records of the Commission concerning this matter. 27 28 FINDINGS OF FACT 29 1. Molly Ann Murphy was initially licensed as a teacher in Oregon on August 12, 2010. 30 Murphy’s Initial Teaching License, with endorsements in English for Speakers of 31 Other Languages (ML/ HS, ECE/ELE), Language Arts (MS, ML), and Multiple 32 Subjects (MIDLVL), issued on April 12, 2010 expired on October 12, 2011. 33 2. On August 3, 2010, Murphy entered into a temporary contract with the Bend-LaPine 34 School District for the 2010-2011 school year, ending June 11, 2011. On November 35 14, 2010 Murphy provided a letter t0 the district resigning her position immediately. 36 3.
