9 On September 16, 2014, the Teacher Standards and Practices Commission
10 (Commission) issued a Notice of Opportunity for Hearing to Dennis Raymond Tiede (Tiede) in
1 1 which the Commission charged him with Gross Neglect of Duty. The Notice was sent via U.S.
12 First Class Mail and U.S. Certified Mail Receipt 7012 1010 0003 2804 4784 to the address on
13 file with the Commission. The Notice designated the Commission file as the record for
14 purposes of proving a prima facie case. The Certified Mail was not returned t0 the Commission.
1 5 The first class mail was not returned to the Commission. The Notice of Opportunity of Hearing,
lo dated September 16, 2014, and signed by Victoria Chamberlain, Executive Director, stated:
1 7 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY PERIOD,
18 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR
19 FAILURE TO REQUEST A HEARING WAS BEYOND YOUR REASONABLE CONTROL.
1 20 IF YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR AT A
‘ 21 HEARING, THE COMMISSION WILL ADOPT AN ORDER OF DEFAULT WHICH MAY
22 INCLUDE THE REVOCATION OR SUSPENSION OF YOUR LICENSE OR OTHER
33 DISCIPLINE.”

25 Tiede did not request a hearing. The Commission, therefore, finds Tiede to be in default and
26 enters the following findings of fact, conclusions of law, and final order, based on the files and
27 records of the Commission concerning this matter.
28 FINDINGS OF FACT
2‘) 1. Tiede been licensed as a teacher in Oregon since November 8, 2010. Tiede’s Charter
30 School Registry Administrator with an endorsement in Administrator (ALL LVL),
31 was issued on November 11, 2013, and expires on November 11, 2016. Tiede
32 previously held an Emergency Administrator License issued November 8, 2010,
33 with an endorsement in Administrator (All Levels), which expired on January 31,
34 2011. During all relevant times, Tiede was employed by the KNOVA Public Charter
3S School in the Reynolds School District.
36 2. On November 12, 2013, the Commission received a report from the Reynolds School
37 District indicating that you had violated professional standards related to licensure.

1 Investigation determined that on or about September 2010, you began employment
2 as the school Principal/ Manger of KNOVA charter school. Your Emergency
3 Administrator License was not issued until November 11, 2010 and was valid until
4 January 31, 2011. You failed to apply for renewal of your expired license or apply for
5 any alternate licensure until October 3, 2013. You functioned as a school
o administrator for KNOVA Charter from September of 2010 through November 2010
7 and again from February 1, 2011, until November 11, 2013, without a valid license or
8 registration. In the course of this investigation, the Commission also learned that
9 you had assigned multiple employees, who did not hold proper license or
10 registration to positions that required proper licensure or registration.
1 l CONCLUSIONS OF LAW
1 2 Tiede’s conduct described above constitutes gross neglect of duty in in violation of ORS
13 342.175(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR 584-020'oo1o(5) (Use
14 professional judgment) ; OAR 584-020-0040(4)(i) (Assigning an educator in violation 0f
1 5 lieensure requirements); OAR 584-020-0040(4)(r) (working without a license); and OAR 584-
lc 050-0006(3)(f) (The applicant has served in violation of OAR 584-050-0035 Must be
17 Licensed, Registered or Certified atAll Times While Employed).

19 The Commission’s authority to impose discipline in this matter is based upon ORS
20 342.175.
21 FINAL ORDER
22 The Commission hereby revokes Dennis Raymond Tiede’s Educator License.
