“23 “k 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS AND 4 Educator License of ) FINAL ORDER OF SUSPENSION 5 DANIELLE UNRUH SHULL ) 0F LICENSE AND PROBATION g On or about March 14, 2016, the Teacher Standards and Practices Commission 8 (Commission) received a report from the Woodburn School District that Danielle Unruh 9 Shull (Shull) may have violated Standards for Competent and Ethical Performance of 10 Oregon Educators. 1 1 After review of the matters alleged, Shull and the Commission agree that their 12 respective interests, together with the public interest, are best served by a stipulation to 13 certain facts and the imposition of a 90 day suspension of Shull’s Preliminary Teaching 14 License followed by a period of probation and fulfillment of specific requirements. 15 By signing below, Shull acknowledges, understands, stipulates, and agrees to the 16 following: (i) she has been fully advised of her rights to notice and a hearing to contest 17 the findings of fact, conclusions of law, and order set forth below, and fully and finally 18 waives all such rights and any rights to appeal or otherwise challenge this Stipulation of 19 Facts and Final Order of Suspension of license (Stipulation and Final Order); (ii) this 20 Stipulation and Final Order is a public document and disclosed to the public upon 21 request to the Commission; (iii) this Stipulation and Final Order is contingent upon and 22 subject to approval and adoption by the Commission. If the Commission does not 23 approve and adopt this Stipulation and Final Order, then neither Iovino nor the 24 Commission are bound by the terms herein; (iv) she has fully read this Stipulation and 25 Final Order, and understands it completely; (v) she voluntarily, without any force or 26 duress, enters into this Stipulation and Final Order and consents to issuance and entry of 27 the Stipulated Final Order below; (vi) she states that no promise or representation has 28 been made to induce her to sign this Stipulation and Final Order; and (vii) she has Page 1 STIPULATION 0F FACTS AND ORDER 0F LICENSE SUSPENSION AND PROBATION - SHULL, DANIELLE UNRUH 1 consulted with an attorney regarding this Stipulation and Final Order and has been fully 2 advised with regard to her rights thereto, or waives any and all rights to consult with an 3 attorney prior to entering into this Stipulation and Final Order and issuance and entry of 4 the Stipulated Final Order below. 5 STIPULATION OF FACI‘ S 6 1. The Commission has licensed Shull as an educator in Oregon since July 25, 2012. 7 Shull’s current Preliminary Teaching License, with an endorsements in English to 8 Speakers of Other Languages (PK-12), Social Studies (PK-12), and Foundational 9 English language Arts (PK-12), issued on January 19, 2016 is valid until January 18, 10 2019. During all relevant times, Shull was employed by the Woodburn School 1 1 District. 12 2. The Commission’s investigation into the report from the Woodburn School District 13 indicated that Shull maintained a parental relationship with a male student which 14 exceeded the professional boundaries of an educator, including expressing a criticism 1 5 of the student’s home life and desire for a better parental support for the student and 16 giving the student personal advice, a book, a birthday card, poem and notebook in 17 which to write his poetry. In his poetry, the student disclosed potential abuse by an 18 uncle which Shull did not report understanding it to be historical in nature and the 19 uncle to have left the country and returned to Mexico. 20 3. On September 8, 21, and 28, 2016; Shull voluntarily underwent four and one half 21 hours of boundaries training through an approved trainer. The trainer reported to 22 the Commission that Shull understands with certainty the boundaries implications of 23 the above conduct and appears to be a committed and creative teacher, dedicated to 24 the well-being of her students. 25 26 27 IT IS SO STIPULATED: 53 haniziig ll mt i4 gin/elk 6(18! I? 30 Danielle Unruh Shull Date i; ‘fin/teas i ZQQMSL/ 51.25 [i 2 33 Dr. Monica Beane, Executive Director Date 34 Teacher Standards and Practices Commission Page 2 STIPULATION OF FACTS AND ORDER 0F LICENSE SUSPENSION AND PROBATION - SHULL, DANIELLE UNRUH 1 CONCLUSION OF LAW 2 Danielle Unruh Shull’s conduct described above constitutes gross neglect of duty in 3 violation of ORS 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it incorporates OAR 584-020- 4 0010(5) (Use professional judgment) and OAR 584-020-0025(2)(e)( Use of District lawful and 5 reasonable rules and regulations) and OAR 584-020-oo3o(2)(b)(Skill in communicating with 6 administrators, students, stafl‘, parents, and other patrons); OAR 584-020-oo4o(4)(o) as it 7 incorporates OAR 584-020-0035(1)(c)(A)(not demonstrating or expressing a professionally 8 inappropriate interest in a students personal life); OAR 584-020-0035(1)(c)(B)(N0t giving 0r 9 exchanging overly personal notes or gifis with a student); and OAR 584-020- 10 oo35(1)(c)(D)(Hon0ring appropriate adult boundaries with students in conduct and 1 1 conversation at all times). 12 The Commission’s authority to impose discipline in this matter is based upon ORS 342.175. 1 3 ORDER 14 The Commission adopts and incorporates herein the above findings of fact and 1 5 conclusions of law, and based thereon, hereby orders as follows: 16 1. Danielle Unruh-Shull’s Preliminary Teaching license is hereby suspended for a 17 period of 90 days from the date of this order; 18 2. Following the suspension Danielle Unruh Shull is placed on probation for a 19 period of 2 years; 20 3. As a condition of probation, Danielle Unruh Shull will comply with the following: 21 a. Provide to the Commission confirmation of completion of NASDTEC 22 boundary training or its equivalent within 30 days of this order; the 23 voluntary boundaries training already completed by Shull satisfies this 24 requirement and; 25 b. Comply with the Standards for Competent and Ethical Performance of 26 Oregon Educators under Oregon Administrative Rules, Chapter 584, 27 Division 020.
