l BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) FINAL ORDER 5 Teaching License of ) OF REVOCATION BY 6 JACK CHARLES PUTNAM ) DEFAULT 7 8 On September 21, 2011, and again on May 23, 2011 (amended), the Teacher Standards and 9 Practices Commission (Commission) issued a Notice of Opportunity for Hearing to Jack Charles 10 Putnam (Putnam) in which the Commission charged him with Gross Neglect of Duty and Gross 11 Unfitness pursuant to ORS 342. 1 75(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR 584- 12 020-0010(5); OAR 584-020-0040(4)(c); and ORS 342.175(l)(c); OAR 584-020-0040(5)(a). The 13 amended Notice was sent via U.S. First Class Mail and U.S. Certified Mail Receipt 701 l 2000 0001 14 1292 2329 to the address on file with the Commission. The Notice of Opportunity of Hearing, dated 15 May 23, 2011, and signed by Victoria Chamberlain, Executive Director, stated: 16 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY PERIOD, l7 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR 18 FAILURE TO REQUEST A HEARING WAS BEYOND YOUR REASONABLE l9 CONTROL. IF YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR 20 AT A HEARING, THE COMMISSION WILL ADOPT AN ORDER OF DEFAULT 21 WHICH MAY INCLUDE THE REVOCATION OR SUSPENSION OF YOUR LICENSE 22 OR OTHER DISCIPLINE.” 23 24 On October 12, 201 1, Putnam requested a hearing. Records indicate Putnam received both the 25 original notice and the amended notice; and all related hearings materials including, notices, 26 discovery, witness lists, and exhibits. Putnam made multiple contacts with Commission staff where 27 he indicated he would be appearing in person at the hearing scheduled for June 6, 2012. Putnam 28 failed to appear at the hearing at the scheduled date and time, or contact any of the parties, or the 29 Office of Administrative Hearings advising of his inability to appear. The Commission, therefore, 3O finds Putnam to be in default and enters the following findings of fact, conclusions of law and order, 31 based on the files and records of the Commission concerning this matter. 32 FINDINGS OF FACT 33 1. Putnam has been licensed as a School Psychologist in Oregon since November 4, 2010. His 34 current Transitional School Psychologist License, with an endorsement in School Psychologist 35 (PP-12), issued on November 4, 2010, expires November 4, 2013. During all relevant times, 36 Putnam was employed by the South Coast Education Service District and North Bend School 37 District. On or about October 20, 2010, Putnam signed and submitted an application to the Commission for 2 licensure in Oregon as a School Psychologist. On April 30, 2010, Putnam was formally advised by the 3 Utah Professional Practice Advisory Commission that he was then under investigation. Putnam 4 answered “no” to question #2 of the Character Questions on his application, which reads: “Are you 5 currently the subject of an inquiry, review, or investigation for alleged misconduct or alleged violation of 6 professional standards of conduct by either an employer or licensure agency?” 7 3. On January 6, 2011, Putnam signed a stipulated agreement with the State of Utah admitting that he 8 “forged an administrator’s signature on a license renewal form, misappropriated the administrator’s 9 social security number and failed to maintain documentation of [his] professional development”. As a 10 result of this conduct, Putnam’s license in Utah was suspended for one year, and Putnam agreed not to l l “seek, accept or continue employment in, or serve as a consultant or independent contractor to, the public 12 schools (grades kindergarten through 12'h grade) or school districts of any state unless and until [he is] 13 reinstated in Utah.” Putnam continued to work for the South Coast Education Service District in 14 violation of this agreement. Putnam further violated this agreement when he applied for employment 15 with the North Bend School District. 16 CONCLUSIONS 0F LAW 17 Putnam’s conduct described in section two (2) above constitutes gross neglect of duty in 18 violation of ORS 342.175(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR 584-020-0010(5) l9 (Use professional judgment); and OAR 584-020-0040(4)(c) (Knowing falsification of any document 20 or knowing misrepresentation directly related to licensure, employment, or professional duties). 21 Putnam’s conduct described in section three (3) above constitutes gross neglect of duty in 22 violation of ORS 342.175(1)(b); OAR 584-020-0040(4)(n) as it incorporates OAR 584-020-0010(5) 23 (Use professional judgment); and OAR 584-020-0040(4)(c) (Knowing falsification of any document 24 or knowing misrepresentation directly related to licensure, employment, 0r professional duties).
