l BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) DEFAULT ORDER 5 Teaching License of ) PUBLIC 6 HUGH ARRON SALKIND ) REPRIMAND 7 8 On April 5, 2011, the Teacher Standards and Practices Commission (Commission) issued 9 a Notice of Opportunity for Hearing to Hugh Aaron Salkind (Salkind) in which the Commission 10 charged him with Gross Neglect of Duty pursuant to ORS 342.175(1)(b); OAR 584-020- 1 1 0040(4)(n), OAR 584-020-001o(5), OAR 584-020-004o(4)(c). The Notice was sent via U.S. 12 First Class Mail and U.S. Certified Mail Receipt 7010 0290 0001 6831 3964 to the address on 13 file with the Commission. The Certified Mail was signed for on April 6, 2011. The Notice of 14 Opportunity of Hearing, dated April 5, 2011, and signed by Victoria Chamberlain, Executive 15 Director, stated: 16 “IF A REQUEST FOR HEARING IS NOT RECEIVED \NITHIN THIS 21-DAY PERIOD, l7 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR l8 FAILURE TO REQUESTA HEARING WAS BEYOND YOUR REASONABLE CONTROL. l9 IF YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR AT A 20 HEARING, THE COMMISSION WILL ADOPT AN ORDER OF DEFAULT WHICH MAY 21 INCLUDE THE REVOCATION OR SUSPENSION OF YOUR LICENSE OR OTHER 22 DISCIPLINE.” 23 24 Salkind did not request a hearing. The Commission, therefore, finds Salkind to be in default and 25 enters the following findings of fact, conclusions 0f law and order, based on the files and records 26 0f the Commission concerning this matter. 27 FINDINGS OF FACT 28 1. Salkind has never been licensed as a teacher in Oregon. On November 23, 2010, the 29 Commission received Salkind’s application for Charter School Registry. 30 2. On November 23, 2010, the Commission received Salkind’s application for Charter School 31 Registry. On the character questions, page 2 of the application Salkind answered “no” to 32 each 0f the 11 questions on the questionnaire, including question number eight; “Have you 33 ever been convicted or granted conditional discharge by any court for: (a) any felony; (b) 34 misdemeanor; (c) any major traflic violation...” Salkind signed this application on 35 November 22, 2010. This response was false. On September 20, 1990, Salkind was 36 convicted of attempting t0 commit crime — possession of a controlled substance (a Class C 37 felony at the time). PAGE 1-DEFAULT ORDER OF REPRIMAND- SALKIND, HIGH AARON l CONCLUSIONS OF LAW 2 Hugh Aaron Salkind’s above described conduct constitutes gross neglect of duty in 3 violation of ORS 342.175(1)(b); OAR 584-020-004o(4)(n) as it incorporates OAR 584-020- 4 0010(5) (Use professional judgment) and OAR 584-020-004o(4)(c) (Knowing falsification of 5 any document or knowing misrepresentation directly related to licensure, employment, or 6 professional duties). 7 The Commission’s authority to impose discipline in this matter is based upon ORS 8 342.175.
