l BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 4 In the Matter of the Educator License of ) DEFAULT ORDER OF 5 KARLI ANN KRUEGER ) PUBLIC REPRIMAND i 6 7 8 On October 31, 2013, the Teacher Standards and Practices Commission (Commission) 9 issued a Notice of Opportunity for Hearing to Karli Ann Krueger (Krueger) in which the 10 Commission charged her with Gross Neglect of Duty. The Notice was sent via U.S. First Class 1 1 Mail and U.S. Certified Mail Receipt 7012 1010 0003 2804 2155 to the address on file with the 12 Commission. The Notice designated the Commission file as the record for purposes 0f proving a 13 prima facie case. The Certified Mail receipt was not returned to the Commission. The regular l4 mail was not returned t0 the Commission, and both are assumed delivered. The Notice of 15 Opportunity of Hearing, dated October 31, 2013, and signed by Victoria Chamberlain, Executive l6 Director, stated: l7 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY PERIOD, l8 YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED UNLESS YOUR l9 FAILURE TO REQUEST A HEARING WAS BEYOND YOUR REASONABLE CONTROL. 20 IF YOU DO NOT REQUEST A HEARING OR IF YOU FAIL TO APPEAR AT A 21 HEARING, THE COMMISSION WILL ADOPT AN ORDER OF DEFAULT WHICH MAY 22 INCLUDE THE REVOCATION OR SUSPENSION OF YOUR LICENSE OR OTHER 23 DISCIPLINE,” 24 25 Krueger did not request a hearing. The Commission, therefore, finds Krueger to be in default 26 and enters the following findings 0f fact, conclusions of law, and final order, based on the files 27 and records of the Commission concerning this matter. 1 28 FINDINGS OF FACT 29 1. Karli Ann Krueger has been licensed by the Commission since August 24, 2011. Krueger 3O currently holds a Charter School Registry, with an endorsement in Music (ML/ HS, 31 ECE/ELE), valid from July 30, 2013, through July 30, 2016. Krueger previously held an 32 Emergency Teaching License issued August 24, 2011, with an endorsement in Music (All 33 Levels), which expired on November 30, 2011. On March 6, 2013, Krueger was issued 34 another Emergency Teaching License, valid until June 30, 2013, to allow Krueger t0 teach 3S until the end of the 2012-2013 school year. During all relevant times, Krueger was employed 36 by the Logos Public Charter School in the Medford School District. 37 2. On August 24, 2011, the Commission issued Krueger an Emergency Teaching License, which 38 allowed Krueger to teach while she completed the requirements for a Charter School Registry. 39 Krueger was required t0 take and pass the Civil Rights exam and then submit her application and PAGE 1-DEFAULT ORDER PUBLIC REPRIMAND- KRUEGER, KARLI ANN l fees for a full Charter School Registry. Krueger passed the exam but failed to make application for 2 her registration, allowing her Emergency Teaching License to expire on November 30, 2011. 3 Krueger continued to teach without a valid license from November 30, 2011, until February 2013, a 4 period of approximately fifteen months. 5 CONCLUSIONS OF LAW 6 Krueger’s conduct described above constitutes gross neglect of duty in violation of ORS 7 342.175(1)(b); OAR 584-o2o-oo4o(4)(n) as it incorporates OAR 584-020-0010(5) (Use 8 professional judgment); OAR 584-020-0040(4)(r) (Knowingly working without a license); and 9 OAR 584-050-0006(3)(f) (The applicant has served in violation of OAR 584-050-0035 Must be 10 Licensed, Registered or Certified at All Times While Employed). l l The C0mn1ission’s authority t0 impose discipline in this matter is based upon 12 ORS 342.175. l 3 FINAL ORDER l4 The Commission hereby issues a Public Reprimand upon Karli Ann Krueger’s educator 15 license. ‘A )1 l6 IT IS SO ORDERED THIS m day of February, 2014. l7 TEACHER STANDARDS AND PRACTICES COMMISSION l8 By: —___ 19 Victoria Chamberlain, Executive Director 2O 21 22 NOTICE OF APPEAL OR RIGHTS 23 24 YOU ARE ENTITLED TO JUDICIAL REVIEW OF THIS ORDER.
