After review of the 14 matters alleged, Wenner and the Commission agree that their respective interests, 15 together with the public interest, are best served by a stipulation to certain facts and the 16 imposition of a four (4) year probation period to commence the date of adoption of this 1 7 order. . 18 By signing below, Wenner acknowledges, understands, stipulates, and agrees to 19 the following: (i) he has been fully advised of his rights to notice and a hearing to contest 20 the findings of fact, conclusions of law, and order set forth below, and fully and finally 21 waives all such rights and any rights to appeal or otherwise challenge this Stipulation of 22 Facts and Final Order of Probation(Stipulation and Final Order); (ii) this Stipulation and 23 Final Order is a public document and disclosed to the public upon request by the 24 Commission; (iii) this Stipulation and Final Order is contingent upon and subject to 25 approval and adoption by the Commission. If the Commission does not approve and 26 adopt this Stipulation and Final Order, then neither Wenner nor the Commission are 27 bound by the terms herein; (iv) he has fully read this Stipulation and Final Order, and 28 understands it completely; (v) he voluntarily, without any force or duress, enters into 29 this Stipulation and Final Order and consents to issuance and entry of the Stipulated 30 Final Order below; (vi) he states that no promise or representation has been made to 31 induce him to sign this Stipulation and Final Order; and (vii) he has consulted with an 32 attorney regarding this Stipulation and Final Order and has been fully advised with 33 regard to his rights thereto, or waives any and all rights to consult with an attorney prior 34 to entering into this Stipulation and Final Order and issuance and entry of the Stipulated Page 1 STIPULATION 0F FACTS AND ORDER OF SUSPENSION- WENNER, LAWRENCE R 1 Final Order below. Wenner understands that the probation will be subject to specific 2 terms and conditions. 3 STIPULATION 0F FACTS 4 1. The Commission has licensed Lawrence R. Wenner since March 21, 2012. 5 Wenner’s current Initial Teaching License with endorsements in Language Arts 6 (HS,ML) and Multiple Subjects (MIDLVL), issued on March 21, 2012, expires on 7 September 21, 2013. Wenner made application for his Oregon License on 8 September 1, 2011. Wenner’s “Yes” answers on the character question section of 9 his application caused an internal referral investigation by the Commission prior 10 to licensure approval. Wenner was not employed as a teacher in Oregon at the 1 1 time of application and investigation. 12 2. Commission investigators learned that Wenner had been investigated and 13 disciplined by his employing school district and the California Commission on 14 Teacher Credentialing. Wenner reported that during a very emotional sensitive 15 period of separation and subsequent divorce, he let several situations in his 16 classroom get the better of him, and he used inappropriate language and had 17 experienced emotional/anger issues in his classroom. Wenner was placed on 18 administrative leave by the Shasta Union High School District (SUHSD) and was 19 ultimately asked to resign his position in 2009. Wenner was also investigated by 20 the California Commission on Teacher Credentialing who suspended his license 21 for thirty days. 22 3. This behavior 5 included the repeated use of profanities and inappropriate comments in the classroom in 6 the presence of students. Wennefs employment was terminated and his California 7 Teaching Credential was suspended for a period of thirty days as a result of his 8 unprofessional behaviors. This conduct constitutes gross neglect of duty in violation of 9 ORS 342.175(1)(b); OAR 584-020-oo4o(4)(n) as it incorporates OAR 584—02o-001o(1) 1O (Recognize the worth and dignity of all persons and respect for each individual), OAR 1 1 584-020-0010(5) (Use professional judgment), OAR 584-020-0030(2)(b) (Skill in 12 communicating with administrators, students, staff, parents, and other patrons); and 13 OAR 584-02o-oo4o(4)(o) as it incorporates OAR 584-020-0035(1)(c)(D)( Honoring 14 appropriate adult boundaries with students in conduct and conversations at all times). 15 The Commission’s authority to impose discipline in this matter is based upon 16 ORS 342.175. 17 ORDER 18 The Commission hereby adopts and incorporates herein the above findings of fact, 19 conclusions of law, and based thereon hereby imposes a period of probation upon 20 Wenner’s Initial Teaching License as follows: 21 The Commission imposes a four (4) year probation upon Wenner to commence 22 the date of adoption of this order and subject to the following terms and 23 conditions of probation: 24 1. Wenner shall comply with the Standards for Competent and Ethical 25 Performance of Oregon Educators under Oregon Administrative Rules 26 Chapter 584, Division 020.
