I 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION , 2 OF THE STATE OF OREGON 3 I 4 In the Matter of the Educator ) DEFAULT ORDER OF DENIAL OF ‘ 5 License of ) APPLICATION AND REVOCATION I 6 ) OF RIGHT TO APPLY I 7 ALAN ISAAC KRAVETZ ) FOR AN EDUCATOR LICENSE 8 9 10 On December 29, 2015, the Teacher Standards and Practices Commission 1 1 (Commission) issued a Notice of Opportunity for Hearing to Alan Isaac Kravetz (Kravetz) in 12 which the Commission charged him with Gross Neglect of Duty and Gross Unfitness. The 13 Notice was sent via U.S. First Class Mail and U.S. Certified Mail Receipt 7015 0640 0004 14 7539 6779 to the address on file with the Commission. The Notice designated the 15 Commission file as the record for purposes of proving a prima facie case. The Certified Mail 16 receipt was returned to the Commission “signed” 0n January 2, 2016. The first class mail 17 was not returned to the Commission. The Notice of Opportunity of Hearing, dated 18 December 29, 2015, and signed by Victoria Chamberlain, Executive Director, stated: 19 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 21-DAY 20 PERIOD, YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED 2] UNLESS YOUR FAILURE TO REQUEST A HEARING WAS BEYOND YOUR 22 REASONABLE CONTROL. IF YOU DO NOT REQUEST A HEARING OR IF YOU 23 FAIL TO APPEAR AT A HEARING, THE COMMISSION WILL ADOPT AN ORDER 24 OF DEFAULT WHICH MAY INCLUDE THE REVOCATION OR SUSPENSION OF 25 YOUR LICENSE OR OTHER DISCIPLINE.” Z6 27 Kravetz did not request a hearing. The Commission, therefore, finds Kravetz to be in default 28 and enters the follom'ng findings of fact, conclusions of law, and final order, based on the 29 files and records of the Commission concerning this matter. 30 FINDINGS OF FACI' 31 1. Kravetz has never been licensed as a teacher in Oregon. Kravetz made application for 32 an Oregon educator license with the Commission on December 18, 2014. As part of 33 the application process, Kravetz was required to answer questions about his 34 background and character. Kravetz’s application was referred to investigations due 35 to affirmative answers on the application’s character questions. l 36 PAGE 1-DEFAULT ORDER OF DENIAL OF APPLICATION AND REVOCATION OF RIGHT TO APPY FOR LICENSURE- ALAN ISAAC KRAVETZ l 1 2. Kravetz completed a TSPC C-i application for an Oregon educator license which was l 2 signed by Kravetz on December 12, 2014. Kravetz answered “yes” t0 character 3 questions numbered 1, 3, 4, 6 and 7” on page four of the TSPC Application for 4 Educator License or Registration Form C-1. Kravetz explained that he had j 5 surrendered his Virginia teaching license on April 28, 2014, in lieu of dismissal and I 6 adverse action upon Kravetz Virginia license. Kravetz acknowledged that he 1 7 understood the reasons for cancellation / surrender were the same as those for 8 revocation of licensure. Kravetz advised investigators that during the 2013-2014 9 school year, while teaching at the Mount Vernon High School in Virginia, Kravetz 10 engaged in a legal and consensual, sexual relationship with a 19-year-old female 11 adult student outside 0f the school setting. Kravetz also reported that once, while 12 out on a date with the female student, Kravetz and the female student were seen 13 together by another student who reported it to school officials. 14 15 CONCLUSIONS OF LAW 16 Alan Isaac Kravetz engaged in unprofessional conduct as described above. This 17 conduct constitutes Gross Neglect of Duty in violation of ORS 342.175(1)(b); OAR 584-020- 18 oo40(4)(n) as it incorporates OAR 584-o2o-oo1o(5) (Use professional judgment), OAR 19 584-020-0025(2)(e)( Using district lawful and reasonable rules and regulations); OAR 20 584-020-0040(4)(o) as it incorporates OAR 584-o2o-oo35(1)(b)(Refrain from exploiting 21 relationships with any student for personal gain, or in support of persons or issues), OAR 22 584-020-0035(1)(c)(A) (Not demonstrating or expressing professionally inappropriate 23 interest in a student’s personal life), OAR 584-020-0035(1)(c)(D) (Honoring appropriate 24 adult boundaries with students in conduct and conversations at all times); and OAR 584- 25 O20-0040(4)(t) (Any sexual conduct with a student). The Commission may rely on the 26 definitions of sexual conduct in ORS 339.370(9) and OAR 584-020-0005(5).
