BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ,\ OF THE STATE OF OREGON In the Matter of the ) Teaching License of ) DEFAULT ORDER DEBORAH G. HALLER ) SUSPENDING LICENSE ) On or about 28, 1997, the Teacher Standards and Practices Commission received a report from the Superintendent of Banks School District, indicating that Deborah G. Haller, a teacher in the district had assisted students in her classroom on the State-wide Writing Assessment by circling misspelled words and requesting students to correct them and by sending one student back to continue working on her writing after the student determined her writing was complete. The Executive Director took action to notify Ms. Haller of intent to impose disciplinary sanctions which could include revocation of her Oregon Teaching license, and to inform Haller or her opportunity for hearing. The notice of opportunity for hearing was sent by U.S. Certified Mail, Return Receipt Requested. Haller responded by letter dated October 7, 1997, waiving her right to a hearing FINDINGS OF FACT 1. Deborah G. Haller holds a Standard Teaching License endorsed in elementary and reading and valid from December 3, 1996 to December 4, 2001. 2. Deborah Haller violated OAR 584-20-035(3)(a) on or about February 10, 1997, by assisting students during the State-wide Writing Assessment. Haller circled misspelled words, requested 1 that students correct them, and sent another student back to continue working on her writing afier the student had determined her writing was complete. 3. Haller violated complete and specific instructions for administering the test, including a caution about correcting students’ tests, as provided by Banks School District and the Oregon Department of Education. ULTIMATE FlNDlNGS OF FACT Knowing falsification of any document or knowing misrepresentation directly related to licensure, employment, or professional duties violates the Standards for Competent and Ethical Performance of Oregon Educators, OAR 584-20-040(4)(c). CONCLUSIONS OF LAW Under ORS 342.175(1)(b) and (4) the Teacher Standards and Practices Commission may suspend or revoke the license of an educator for gross neglect of duty. Violation of standards adopted the Commission relating to competent and ethical performance of professional duties shall be admissible as evidence of gross neglect of duty. : PAGE l--DEFAULT ORDER--DEBORAH G. HALLER ORDER I The Commission suspends the Oregon Standard Teaching License #249706, issued to Deborah G. Haller, for a period of one year. Haller’s license may be reinstated afler one year upon submission of a transcript verifying completion of a course or workshop approved by the Oregon Teacher Standards and Practices Commission on professional ethics.
