5 MARY LYNN BOND ) OF SUSPENSION

6 On or about June 20, 2007, the Teacher Standards and Practices Commission (Commission)

7 received a report from Greg Thede, Superintendent, Klamath County School District alleging that

8 Mary Lynn Bond (Bond) violated standards when she consumed alcohol on school grounds.

9 Ms. Bond fully cooperated with the Commission's investigation. After review of the matters
10 alleged, Ms. Bond and the Commission agree that their respective interests, together with the public
11 interest, are best sewed by a stipulation to certain facts and the imposition of anjgigg't ((88)) [1%
12 suspension of Iicensure.
13 This document sets forth the facts upon which the parties have agreed and the stipulated
14 sanction to be imposed. Ms. Bond stipulates that there is sufficient evidence in the Commission's files
15 and records to support the findings of fact, conclusions of law, and order set forth below.
16 By signing below, Ms. Bond acknowledges, understands, stipulates, and agrees to the
17 following: (i) she has been fully advised of her rights to notice and a hearing to contest the findings of
18 fact, conclusions of law, and order set forth below, and fully and finally waives all such rights and any
19 rights to appeal or othen/vise challenge this Stipulation of Facts and Final Order of Suspension
20 (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public document and disclosed to
21 the public upon request by the Commission; (iii) this Stipulation and Final Order is contingent upon
22 and subject to approval and adoption by the Commission. If the Commission does not approve and
23 adopt this Stipulation and Final Order, then neither Ms. Bond nor the Commission are bound by the
24 terms herein; (iv) she has fully read this Stipulation and Final Order, and understands it completely;
25 (v) she voluntarily, without any force or duress, enters into this Stipulation and Final Order and
26 consents to issuance and entry of the Stipulated Final Order below; (vi) she states that no promises or
27 representation has been made to induce her to sign this Stipulation and Final Order; and (vii) she has

1 consulted with an attorney regarding this Stipulation and Final Order and has been fully advised with
2 regard to her rights thereto, or waives any and all rights to consult with an attorney prior to entering
3 into this Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. This
4 Order sets forth the facts upon which the parties have agreed and the sanction to be imposed. Ms. .-
5 Bond stipulates that there are sufficient facts contained in the Commission's files and records to
6 support the findings of fact and conclusions of law set forth below. In entering into this stipulation, Ms.
7 Bond waives the right to a hearing to contest the findings of fact, conclusion of law and order set forth
8 below. Ms. Bond understands that the probation wiII be subject to specific terms and conditions.
9 STIPULATION OF FACTS

10 1. The Commission has licensed Ms. Bond since November 13, 1990. Ms. Bond currently holds

11 a Standard Teaching license, issued June 22, 2007, expiring June 21, 2012, with an

12 endorsement in Standard Elementary Education.

13 2. On November 7, 2005 the Commission adopted a stipulated order imposing a public

14 reprimand and a four (4) year probation on the licensure of Ms. Bond for appearing on duty in

15 the influence of alcohol.

16 3. In $2007, Ms. Bond consumed alcohol while on duty in the Klamath County School

17 District. No students were aware of this conduct.

1 CONCLUSIONS 0F LAW
2 ln April of 2007 Ms. Bond consumed alcohol while on duty. This conduct constitutes Gross
3 Neglect of Duty in violation of OAR 584-020-0040(4)(g) and OAR 584-020-0040(4)(k). The
4 Commission's authority to impose discipline in this matter under ORS 342.120 through 342.430 and
5 OAR Chapter 584.
6 ORDER
7 The Commission adopts and incorporates herein the above finding of facts, conclusions of
8 law, and based thereon, hereby imposes anlgiigmmg?n?ntfsuspension upon Mary Lynn Bond's
9 Standard Teaching License effective the date of this Order.
10 Upon the reinstatement of Iicensure, Ms. Bond will be placed on probation by the Commission
11 for a period of four (4) years, subject to the following conditions:
12 1. Ms. Bond shall, at her own initiative and expense, continue to obtain treatment for her
13 alcohol dependency as recommended by her alcohol treatment provider.
14 2. During the period of this probation, Ms. Bond shall submit to the Executive Director of the
15 Commission reports of her compliance with the aftercare treatment plan. Ms. Bond shall provide
16 these reports every six (6) months during her probation.
17 3. Ms. Bond shall report in writing within ten days to the Executive Director of the Commission
18 any arrest or citation for any felony, misdemeanor, major traffic violation or criminal probation; and
19 4. Ms. Bond shall comply with the Standards for Competent and Ethical Performance of
20 Oregon Educators under Oregon Administrative Rules Chapter 584, Division 020.
21 Violation of any term or condition of probation shall constitute an independent basis for the
22 Commission to revoke Ms. Bond's teaching license or othenivise impose discipline, after first providing
23 Ms. Bond with notice and opportunity for hearing.
