OF THE STATE OF OREGON i In the Matter of the ) 5 Teaching License of ) STIPULATION OF FACTS, 6 PATRICIA GAIL PENNINGTON ) SURRENDER AND ORDER OF 7 ) REVOCATION 8 On August 5, 2002, the Teacher Standards and Practices Commission 9 (Commission) informed Patricia Gail Pennington (Pennington) that the Commission had 10 sufficient evidence to charge her with knowing misrepresentation directly related to her 11 November 28, 2001, Application for Educator License Form C-1 with the Commission. 12 Ms. Pennington failed to report a 1998 conviction for Theft III in Klamath County Circuit 13 Court, Klamath Falls, Oregon. 14 Ms. Pennington fully cooperated with the Commission’s investigation. After a 15 review of the matters alleged, Ms. Pennington and the Commission have agreed that 16 their respective interests, together with the public interest, are best served by a 17 stipulation of facts and a voluntary surrender of Ms. Pennington‘s Oregon Teaching 18 License in accordance with OAR 584-050-0027. In entering into this stipulation, 19 Ms. Pennington waives her right to a hearing and understands that the Commission will 20 accept the voluntary surrender of her license and will revoke the license. 21 Ms. Pennington enters into this Stipulation of Facts with knowledge the 22 Commission will revoke her Oregon Teaching License. This stipulation is contingent 23 upon approval and adoption of the order by the Commission. Ms. Pennington holds a Basic Oregon Teaching License with Basic Language 3 Arts, Basic Drama and Standard Handicapped Learner I Endorsements issued January 4 16, 2002, valid until September 3, 2005. She has held a teaching licensed issued by 5 the Commission since 1993. 6 2. Ms. Pennington holds a life-time California Standard Teaching Credential 7 issued on July 9, 1974. 8 3. On or about November 28, 2001, Ms. Pennington signed and submitted an 9 Application for Educator License Form C-1 to the Commission. Ms. Pennington made 10 knowing misrepresentation on her application for Iicensure by responding “no” to 11 character question, “8. Have you ever been convicted or been granted conditional discharge by any court for: (a) any felony; (b) misdemeanor; or (c) any major traffic i violation...?" Ms. Pennington failed to report a conviction for Theft III (misdemeanor) in 14 Circuit Court of the State of Oregon for Klamath County on June 24, 1998. 15 4. Violation of this 4 Standard constitutes Gross Neglect of Duty.
