6 On June 7, 2005, Christine Marie Nichols (Nichols) submitted an Application for
7 Conditional Assignment Permit for a Basic Superintendent Endorsement for the 2004-2005
8 school year to the Teacher Standards and Practices Commission (Commission). The
9 application was authorized by Christine Nichols, Superintendent, Brookings Harbor School
10 District Records maintained by the Department of Education indicate that Ms. Nichols served
11 as the Superintendent for Brookings Harbor School District during the 2004-2005 school year.
12 Ms. Nichols fully cooperated with the Commission’s investigation. After review of the
13 matters alleged, Ms. Nichols and the Executive Director agree that their respective interests,
together with the public interest, are best served by a stipulation to certain facts and a public
§ reprimand.
16 This document sets forth the facts upon which the parties have agreed and the
17 stipulated sanction to be imposed. Ms. Nichols stipulates that there is sufficient evidence in the
18 Commission's files and records to support the findings of fact, conclusions of law, and order set
19 forth below.
20 By signing below, Ms. Nichols acknowledges, understands, stipulates, and agrees to the
21 following: (i) she has been fully advised of her rights to notice and a hearing to contest the
22 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all
23 such rights and any rights to appeal or othewvise challenge this Stipulation of Facts and Final
24 Order of Repn'mand (Stipulation and Final Order); (ii) this Stipulation and Final Order is a public
25 document and disclosed to the public upon request by the Commission; (iii) this Stipulation and
Final Order is contingent upon and subject to approval and adoption by the Commission. If the
6 Commission does not approve and adopt this Stipulation and Final Order, then neither Ms.

‘ Nichols nor the Commission are bound by the terms herein; (iv) she has fully read this
2 Stipulation and Final Order, and understands itcompletely; (v) she voluntarily, without any force
3 or duress, enters into this Stipulation and Final Order and consents to issuance and entry of the
4 Stipulated Final Order below; (vi) she states that no promises or representation has been made
5 to induce her to sign this Stipulation and Final Order; and (vii) she has consulted with an
6 attorney regarding this Stipulation and Final Order and has been fully advised with regard to her
7 rights thereto, or waives any and all rights to consult with an attorney prior to entering into this
8 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below.
9 STIPULATION OF FACTS
10 1. The Commission has licensed Christine Marie Nichols since October 23, 1978.
11 Ms. Nichols currently holds a Standard Administrative License valid October 8, 2004, through
12 October 28, 2009, with a Standard Administrator endorsement.
2. Ms. Nichols has been employed by the Brookings Harbor School since 1992. Ms.
i Nichols served as an administrator from 1992-2004. Ms. Nichols has been serving as
15 Superintendent of Brookings Harbor School District Since August of 2004.
16 3. On June 7, 2005, Ms. Nichols applied for a Basic Superintendent Endorsement for
17 conditional assignment. The Commission processed said Conditional Assignment Permit on
18 June 16, 2005.
19 4. Ms. Nichols served as Superintendent of Brookings Harbor School District without
20 proper licensure during the 2004-2005 school year.

‘1 CONCLUSION OF LAW
2 During the 2004-2005 school year Christine Marie Nichols served as a Superintendent of
3 Brookings Harbor School District without proper Iicensure in violation of OAR 584-050-0030(2).
4 This misconduct constitutes Gross Neglect of Duty. The Commission has the authority to
5 impose discipline in this matter is under ORS 342.120 through 342.430 and OAR Chapter 584.
6 FINAL ORDER
7 The Commission hereby adopts and incorporates herein the above findings of fact and
s conclusion of law and based thereon, here by imposes a Public Reprimand on Christine Marie
9 R. Nichols. This Order shall serve as the Public Reprimand.
