OF THE STATE OF OREGON 3 4 In the Matter of the ) 5 Teaching License of ) DEFAULT ORDER OF 6 BRUCE ALEXANDER SMITH ) LICENSE REVOCATION 7 ) 8 9 On August 6, 2002, the Teacher Standards and Practices Commission (Commission) 10 issued a Notice of Opportunity for Hearing to Bruce Alexander Smith (Smith), in which the 11 Commission proposed to suspend or revoke the teaching license of Bruce Alexander Smith or 12 othen/vise impose discipline under ORS 342.177. The notice was sent via U.S. First Class Mail 13 and U.S. Certified Mail Receipt 7001 0320 0005 0740 8674 to the address provided to the 14 Commission. The certified mail receipt was signed and dated on August 24, 2002. The Notice 15 of Opportunity of Hearing, dated August 6, 2002, and signed by Victoria Chamberlain, Executive 16 Director, stated: ‘ "You, Bruce Alexander Smith, are entitled to a hearing on the proposed action of 18 the Commission. If you want a hearing, you must file a written request for a 19 hearing with the Commission within 21 days of the date of this notice. Attached 20 to this notice is a copy of the procedures, right of representation and other rights 21 of parties relating to the conduct of a hearing as required under ORS 22 183.413(2).” 23 24 Mr. Smith did not request a hearing. The Commission, therefore, finds Mr. 25 Smith to be in default and enters the following findings of fact, conclusions of law and 26 order, based on the files and records of the Commission concerning this matter. 27 FINDINGS 0F FACT 28 1. Bruce Alexander Smith has been licensed by the Commission since July 20, 1984. 29 Mr Smith holds a Teacher Limited License issued September 6, 2001, valid until September 6, 30 2004. 31 2. Mr. Smith was employed by Portland Public Schools as a Dance Teacher beginning 32 in 1984 until resignation effective April 30, 2002. ' PAGE 1 -— DEFAULT ORDER OF LICENSE REVOCATION - SMITH 1 3. On July 17, 2002, Bruce Alexander Smith was convicted of Sexual Abuse Ill, ORS .2 163.415, in the Circuit Court for the State of Oregon for Multnomah County. The court 3 sentenced Mr. Smith to three years probation and ordered him to pay a monetary judgment of 4 $565.00. 5 4. The conviction listed above was a result of Mr. Smith's relationship with a Portland 6 Public School student. 7 CONCLUSIONS 0F LAW 8 The crime of Sex Abuse Ill, ORS 163.415, is listed in ORS 342.143(3).
