‘ BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND 5 ADAM J. DAVIS ) ORDER OF REPRIMAND 6 On or about February 10, 2004, the Teacher Standards and Practices Commission 7 (Commission) received an application for renewal of an Initial Teaching License from Adam J. 8 Davis (Davis). The Reynolds School District submitted a PEER form indicating that during the 9 2001-2002 and 2002-2003 school years Davis served as Special Education teacher without a 10 Special Education endorsement. 11 After review of the matters alleged, Mr, Davis and the Executive Director agree that their 12 respective interests, together with the public interest, are best served by a stipulation to certain 13 facts and a public reprimand. ‘4 This Order sets forth the facts upon which the parties have agreed and the sanction to 15 be imposed. Mr. Davis stipulates that there are sufficient facts contained in the Commission’s 16 files and records to support the findings of fact and conclusions of law set forth below. In 17 entering into this stipulation, Mr. Davis waives the right to a hearing to contest the findings of 18 fact, conclusion of law and order set forth below. 19 This stipulation is contingent upon approval and adoption of the Order by the 20 Commission. If the Commission does not adopt this Order, neither Mr. Davis nor the 21 Commission are bound by these Stipulations, and Mr. Davis retains all rights to a hearing on the 22 allegations. 23 STIPULATION OF FACTS 24 1. On July 12, 2000, the Commission issued Mr. Davis an Initial Teaching License with 25 endorsements in Multiple Subjects Middle Level and Multiple Subjects Self-Contained ‘6 Elementary Level. Mr. Davis applied for a Special Education teaching position in September of 2001 2 and was hired to teach Special Education by Reynolds School District. 3 3. Mr. Davis served as a Special Education Teacher for Reynolds School District 4 without proper licensure for the 2001-2002 and 2002-2003 school years by teaching Special 5 Education without a Special Education endorsement. 6 CONCLUSION OF LAW 7 Adam J. Davis sewed without proper licensure in violation of OAR 584-050-0030(1) and 8 OAR 584-020-0040(4)(c) during the 2001-2002 and 2002-2003 school years, This misconduct 9 constitutes Gross Neglect of Duty.
