l 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACI‘ S AND 4 Educator License of ) FINAL ORDER 0F REVOCA'ITON 5 JON LOREN BISHOP ) 6 On or about November 8, 2012, the Teacher Standards and Practices Commission 7 (Commission) received information from the Riddle School District (“district”), indicating that 8 licensed educator, Jon Loren Bishop (Bishop), may have committed acts which constitute gross 9 neglect of duty. 10 After review of the matters alleged, Bishop and the Commission agree that their 1 1 respective interests, together with the public interest, are best served by a stipulation to certain 12 facts, and the revocation of Bishop’s license. 13 This document sets forth the facts upon which the parties have agreed and the stipulated 14 sanction to be imposed. Bishop stipulates that there is sufficient evidence in the Commission’s 15 files and records to support the findings of fact, conclusions of law, and order set forth below. 16 By signing below, Bishop acknowledges, understands, stipulates, and agrees to the 17 following: (i) he has been fully advised of his rights to notice and a hearing to contest the 1 8 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 19 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts and Final 20 Order of Revocation (Stipulation and Final Order); (ii) this Stipulation and Final Order is a 21 public document and disclosed to the public upon request by the Commission; (iii) this 22 Stipulation and Final Order is contingent upon and subject to approval and adoption by the 23 Commission. If the Commission does not approve and adopt this Stipulation and Final Order, 24 then neither Bishop nor the Commission are bound by the terms herein; (iv) he has fully read 25 this Stipulation and Final Order, and understands it completely; (v) he voluntarily, Without any 26 force or duress, enters into this Stipulation and Final Order and consents to issuance and entry 27 of the Stipulated Final Order below; (vi) he states that no promises or representation has been 28 made to induce him to sign this Stipulation and Final Order; and (vii) he has consulted with an Page 1 STIPULATION OF FACTS, ORDER OF REVOCATION — BISHOP, JON 1 attorney regarding this Stipulation and Final Order and has been fully advised with regard to his 2 rights thereto, or waives any and all rights to consult with an attorney prior to entering into this 3 Stipulation and Final Order and issuance and entry of the Stipulated Final Order below. In 4 entering into this stipulation, Bishop waives the right to a hearing to contest the findings of fact, 5 conclusions of law and order set forth below. 6 STIPULATION OF FACTS 7 1) The Commission has licensed Bishop since June 3o, 1988. Bishop holds a Standard 8 Teaching License issued February 16, 2008, with endorsements in Basic language Arts 9 (020), and Standard Social Studies (020), which was scheduled to expire on February 15, 10 2013. On February 5, 2013, Bishop made timely application for renewal, and his license 11 status was pended until related investigations could be completed and resolved. 12 2) On or about November 7, 2012, the district received a patron complaint regarding, among 13 other things, alleged inappropriate text messages between Bishop and a 13 year old female 14 student (AR). 15 3) Investigations determined that between October 27, 2012, and November 7, 2012, (12 16 calendar days) Bishop sent student AR 177 text messages and AR had sent him 165 text 17 messages. Records indicate that Bishop’s texting of AR would begin as early as 6:53 in the 18 morning and continue as late as 10:20 in the evening. Bishop’s text messages contained 19 comments including “Here, luv you”, and “sexy shorts LOL". AR advised that at times, 20 Bishop’s texting made her feel uncomfortable and “Creeped her out”. The investigation 21 also revealed that AR’s mother was aware that Bishop had been texting AR. Based on the 22 investigation, Bishop was issued a written reprimand which indicated that while Bishop’s 23 intentions were to assist ARwith problems in a counseling capacity, he acted 24 unprofessionally by sending an excessive number of text messages to AR and by using the 25 phrase "luv you.” Bishop was further instructed to “cease and desist from all electronic 26 communication...of students at Riddle School District.” Page 2 STIPULATION OF FACTS, ORDER OF REVOCATION — BISHOP, JON 1 4) In March of 2013, the school district received a complaint that Bishop had engaged in 2 communications with a former student (KB), who had recently left the school district. Upon 3 learning of the complaint, TSPC, the school district and local law enforcement each 4 conducted investigations. Bishop told investigators that he believed this communication was 5 okay because the student was no longer a student in the Riddle School District. In addition 6 to texting KB, Bishop traveled to her home to visit her and to check on her living conditions, 7 where he met with KB and her guardian. Bishop continued to communicate with KB and 8 tracked her foster care placements. This conduct 21 constitutes Gross Neglect of Duty in violation of ORS 342.175(1)(b); OAR 584-o2o-oo4o(4)(n) 22 as it incorporates OAR 584-020-001o(5) (Use professional judgment),OAR 584-020- 23 oo3o(2)(b) (Skill in communicating with administrators, students, stafl and other patrons); 24 OAR 584-020-oo4o(4)(o) as is incorporates OAR 584-020-0035(1)(c)(A) (Not demonstrating 25 or expressing professionally inappropriate interest in a student’s personal life), and OAR 584- 26 020-0035(1)(c)(D) (Honoring appropriate adult boundaries with students in conduct and 27 conversation at all times).
