8 On May 23, 2007, the Teacher Standards and Practices Commission (Commission) issued a

9 Notice of Opportunity for Hearing to Matthew Todd Gould (Gould) in which the Commission charged
10 him with conviction of a crime listed in ORS 342.143(3). The Notice was sent via U.S. First Class Mail
11 and U.S. Certified Mail Receipt 7005 1160 0001 0494 2994 to the address obtained by the
12 Commission. The U.S. First Class Mail was signed by Lyn Hust, Snake River Correctional Institution
13 and returned to the Commission on May 29, 2007. The Notice of Opportunity of Hearing, dated May
14 23, 2007, and signed by Victoria Chamberlain, Executive Director, stated:
15 "You, Matthew Todd Gould, are entitled to a hearing on the proposed action of the
16 Commission. If you want a hearing, you must file a written request for a hearing with
17 the Commission within 21 days of the date of this notice. Attached to this notice is a
18 copy of the procedures, right of representation and other rights of parties relating to the
, conduct of a hearing as required under ORS 183.413(2)."
21 Mr. Gould did not request a hearing. The Commission, therefore, finds
22 Mr. Gould to be in default and enters the following findings of fact, conclusions of law and
23 order, based on the files and records of the Commission concerning this matter.
24 FINDINGS OF FACT
25 1. Mr. Gould has been licensed by the Commission since August 15, 1984. The Commission
26 issued Mr. Gould a Standard Teaching License on January 24, 2002, valid until January 10, 2007,
27 with Basic Elementary and Basic Reading Endorsements. Said license expired January 10, 2007. ‘
28 2. Mr. Gould began employment with Silver Falls School District on January 18, 1996. i
29 3. On 0r about April 16, 2007, Mr. Gould was convicted of fifteen (15) counts of Sex Abuse l,
30 ORS 163.427, in the Circuit Court of the State of Oregon for Marion County.

1 CONCLUSIONS OF LAW
’ Mr. Gould's conviction of fifteen (15) counts of Sex Abuse l, ORS 163.427, constitutes a

3 conviction for which the Commission shall revoke a license pursuant to OAR 584-020-0040(1). The

4 Commission is required to revoke Mr. Gould’s right to apply for a license pursuant to ORS 342.175(2).

5 The Commission's authority to impose discipline in this matter is based upon ORS 342.175.

6 ORDER

7 The Commission hereby revokes Matthew Todd Gould's right to apply for a teaching license.
