DOUGHER'PY ) AND PROBATION 7 1 8 9 On March 15, 1999, the Teacher Standards and Practices Commission informed Stephen 10 Dougherty that the Commission found sufficient evidence of violation of Standards for 11 Competent and Ethical Performance of Oregon Educators to warrant a hearing regarding the 12 charges. Mr. Daugherty requested a hearing on the allegations, but before a hearing date was l3 set, the parties have agreed that their respective interest and the interests of the State are best l4 served by a Stipulation of Facts and Order of Public Reprimand and Probation as set forth 15 below. 16 17 STIPULATION OF FACTS 18 , 19 l. Stephen R. Dougherty holds a Standard Teaching License endorsed for Physical 20 Education, Health and Driver Education and valid from March 27, 1998 to February 7, 21 2003. 22 23 2. On or about January 30, 1997, Daugherty used inappropriate language in the 24 classroom and failed to maintain a classroom conducive to learning when he began 25 yelling from the front of the class to the back of the room. 26 27 3. On or about January 30, 1997, Daugherty shoved an empty desk into a desk occupied 28 by a student knocking books to the floor. He shoved a desk with a student in it with 29 sufficient force to cause the desk to face the rear of the classroom. . 30 ( 31 4. On or about April 3, 1997, Daugherty failed to recognize the worth and dignity of 32 students and to use professional judgment and appropriate language when he spent 33 five minutes of each class period that day dispelling rumors about his suspension by 34 Salem-Keizer School District. 35 36 Stephen R. Daugherty enters into this Stipulation of Facts with knowledge that the Teacher 37 Standards and Practices Commission will impose a Public Reprimand and period of Probation 38 as stated under the “Order” on page two of this stipulation. This Stipulation is contingent 39 upon approval and adoption of the Order by the Commission. If the Commission does not 4O adopt this Order, neither Mr. Daugherty nor the Commission is bound by these stipulations 41 and Mr. Daugherty retains all rights to a hearing on the allegations. . Daugherty failed to use professional judgment in use of unreasonable physical force 4 against students and use of inappropriate language in communicating with students in Salem- 5 Keizer School District. 6 7 CONCLUSIONS OF LAW 8 9 Under ORS 342.175 the Commission may impose sanctions including revocation of license for 10 violations of Standards of Competent and Ethical Performance. 11 12 ORDER l3 l4 The Commission imposes a Public Reprimand for failure to adhere to Standards of Competent 15 and Ethical Performance and places Stephen R. Daugherty on probation for a period of two 16 years. During the period of probation Daugherty shall: l7 18 l) Conduct himself as a law-abiding citizen; 19 20 2) Comply with Standards of Competent and Ethical Performance for Oregon Educators; 2 l 22 3) Daugherty will provide to the Commission such information as requested to verify 23 that he has complied with the conditions of probation, including a statement from his 24 employing district that he has complied with the Standards for Competent and Ethical 25 Performance; and 26 27 4) Daugherty will notify the Commission's Executive Director of any discipline or 28 investigation occurring during the period of probation. 29 . 30 Violation of any terms of probation shall constitute a basis for the Commission to revoke 31 Dougherty’s license, after first providing to Daugherty notice and opportunity for hearing. 32 33 4v 34 Dated this Z i day of , 1999. 35 36 TEACHER STA ARDS AND PRACTICES COMMISSION 37 38 . 39 M 40 By 41 David V.
