1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ‘ OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Teaching License of ) AND 5 Charles Walter Kuwahara ) ORDER OF REPRIMAND s On or about October 7, 2005, the Teacher Standards and Practices Commission 8 (Commission) received a report from Thomas Crane, Superintendent, Pine-Eagle School 9 District, indicating that Charles Walter Kuwahara (Kuwahara) appeared at the Pine Eagle High 10 School Graduation, a district sponsored event, under the influence of alcohol. 11 TSPC was not able to interview Mr. Kuwahara concerning these events. After review of 12 the matters alleged, Mr. Kuwahara and the Commission agree that their respective interests, 13 together with the public interest, are best served by a stipulation to certain facts and the 14 imposition of a Public Reprimand. 15 This Order sets forth the facts upon which the parties have agreed and the sanction to . be imposed. Mr. Kuwahara stipulates that there are sufficient facts contained in the 17 Commission's files and records to support the findings of fact and conclusions of Iaw set forth 18 below. In entering into this stipulation, Mr. Kuwahrara waives the right to a hearing to contest 19 the finding of fact, conclusion of law and order set forth below. 20 This stipulation is contingent upon approval and adoption of the Order by the 21 Commission. If the Commission does not adopt this Order, neither Mr. Kuwahara nor the 22 Commission are bound by these Stipulations and Mr. Kuwahara retains all rights to a hearing on 23 the allegations. 24 STIPULATION 0F FACTS 25 1. Mr. Kuwahara holds a Standard Teaching License valid until January 2, 2008. There 26 are no previous complaints on fiIe with the Commission. 27 2. On June 4, 2005, Mr. Kuwahara attended the Pine-Eagle High Scholl graduation, a . District sponsored event as a parent. While attending this District sponsored event Mr. 3 Kuwahara appeared visibly intoxicated. 4 4. CONCLUSION OF LAW Q7 Mr. Kuwahara violated OAR 584-020-0040(4)(g) by attending a Distn'ot sponsored 18 activity while under the influence of alcohol at the Pine-Eagle High School graduation in June of 19 2005. This misconduct constitutes Gross Neglect of Duty.
