‘ BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) SURRENDER AND 5 DUSTIN TIMOTHY BECK ) ORDER OF REVOCATION l 6 On or about June 3, 2005, the Teacher Standards and Practices Commission 7 (Commission) received several newspaper articles reporting that Dustin Timothy Beck (Beck), a 8 teacher at Mohawk High School, was arraigned in Lane County Circuit Court on charges of 9 sodomy and sexual abuse. 10 After review of the matters alleged, Mr. Beck and the Commission agree that their 11 respective interests, together with the public interest, are best sewed by a stipulation to certain 12 facts and surrender of his teaching license as per OAR 584-050-0027. 13 This Order sets forth the facts upon which the parties have agreed and the sanction to be imposed. Mr. Beck stipulates that there are sufficient facts contained in the Commission's q files and records to support the findings of fact and conclusions of law set forth below. In 16 entering into this stipulation, Mr. Beck waives the right to a hearing to contest the finding of fact, 17 conclusion of law and order set forth below. Mr. Beck understands that the Commission will 18 revoke his teaching license. 19 This stipulation is contingent upon approval and adoption of the Order by the 20 Commission. If the Commission does not adopt this Order. neither Mr. Beck nor the ‘ 21 Commission are bound by these Stipulations and Mr. Beck retains all rights to a hearing on the 22 allegations. 23 STIPULATION OF FACTS 24 1. Mr. Beck has been licensed by the Commission since August 21, 1998. The 25 Commission issued a Standard Teaching License to Mr. Beck on November 7, 2001, valid until f December 13, 2006, with Basic Chemistry, Basic Physics and Standard Biology Endorsements. Page 1 STIPULATION OF FACTS, SURRENDER AND ORDER OF REVOCATION - BECK d 2. Mr. Beck began teaching for Marcola School District as a Science teacher at 2 Mohawk High School in August of 1998. 3 3. By letter dated July 18, 2005, Mr. Beck offered to surrender his teaching license. 4 On August 15, 2005, the Marcola School Board accepted Mr. Beck's resignation. 5 4. 0n September 30, 2005, Mr. Beck pled guilty and was convicted of Sex Abuse in the 6 Third Degree, ORS 163.415, and Sexual Abuse in the Second Degree (four counts), ORS 7 163.425, in the Circuit Court for the State of Oregon for Lane County. 8 5. ' Date Teacher Stand . and Practices Commission 16 coucwsious OF LAW 17 The crimes for which Dustin Timothy Beck was convicted are listed in ORS 342.143(3) 18 as crimes that disqualify a person from holding a teaching license in the State of Oregon. 19 Pursuant to ORS 342.175(2), the Commission is required to revoke the Oregon Standard 20 Teaching License issued to Dustin Timothy Beck and to revoke his right to apply for a license. 21 This misconduct constitutes Gross Neglect of Duty.
