8 On February 8, 2005, the Teacher Standards and Practices Commission (Commission)
9 issued a Notice of Opportunity for Hearing to Jason Michael Ray (Ray) in which the Commission
10 charged him with conviction ot crimes listed in ORS 342.143(3). The Notice was sent via U.S.
11 First Class Mail and U.S. Certified Mail Receipt #7003 2260 0000 8922 9613 to the address
12 Mr. Ray provided to the Commission. The certified mail receipt was signed by Mr. Ray and
13 returned to the Commission on February 10, 2005. The Notice of Opportunity of Hearing, dated
14 February 8, 2005, and signed by Victoria Chamberlain, Executive Director, stated:
15 "You, Jason Michael Ray, are entitled to a hearing on the proposed action of the
16 Commission. It you want a hearing, you must file a written request for a hearing
7 with the Commission within 21 days of the date of this notice. Attached to this
. notice is a copy of the procedures, right of representation and other rights of
9 parties relating to the conduct of a hearing as required under ORS 183.413(2)."

21 Mr. Ray did not request a hearing. The Commission, therefore, finds
22 Mr. Ray to be in default and enters the following findings of tact, conclusions 0t law and
23 order, based on the files and records of the Commission concerning this matter.
24 FINDINGS OF FACT
25 1. Mr. Ray currently holds a Standard Teaching License issued May 9, 2001, valid until
26 May 4, 2006, with a Standard Music Endorsement.
27 2. Mr. Ray was employed by the Klamath County School District from August 26, 2002
28 until April 14, 2004.
29 h 3. On or about February 1, 2005, Jason Michael Ray was convicted of two counts of
30 Sexual Abuse Ill, ORS 163.415, in the Circuit Court oi the State of Oregon for the County of
In Klamath.

.1 4. On or about February 1, 2005, Jason Michael Ray was convicted of two counts 0t
2 Official Misconduct I, ORS 162.415, in the Circuit Court of the State of Oregon ior the County ot
3 Klamath.
4 CONCLUSIONS 0F LAW
5 Mr. Ray's criminal convictions in this matter, Sexual Abuse III and Official Misconduct I,
6 are the result of sexual acts involving Klamath County Public School students. The crime of
7 Sexual Abuse lII as defined in ORS 163.415 is listed in ORS 342.143(3). The Commission is
8 required to revoke the Oregon Standard Teaching License issued to Jason Michael Ray and
9 revoke his right to apply for a license pursuant to ORS 342.175(2).
10 Mr. Ray’s convictions for Official Misconduct I, ORS 162.415 constitute Gross Unfitness
11 in violation of OAR 584-020-0040(5)(c). The Commission's authority to impose discipline in this
12 matter is based upon ORS 342.175.
3 ORDER
Qt The Commission hereby revokes the Oregon Standard Teaching License issued to
15 Jason Michael Ray and revokes his right to apply for a teaching license.
