The Commission and ‘ 14 Pippin have now reviewed the matters alleged and agree that their 15 respective interests, together with the public interest, are best 16 served by a stipulation to certain facts, the revocation of 17 Pippin's license reinstatement rights and the imposition of 18 certain conditions for reinstatement of his license. This 19 agreement sets forth the facts upon which the parties have agreed 20 and the sanctions to be imposed. In entering into this 21 Stipulation, Pippin waives his right to a hearing to contest any 22 of the findings set forth below. 23 /// 24 /// 25 /// 26 /// 1 ‘PAGE l — STIPULATION OF FACTS AND ORDER OF REVOCATION OF RIGHT 'I'O i j LICENSE REINSTATEMENT l FINDINGS OF FACT . 2 Pippin agrees and stipulates that evidence in the record 3 exists to support the following Findings of Fact by the Commission: 4 ' 1. Pippin holds a standard teaching license that expired 5 on January 26, 1996. TSPC has no record of receiving an 6 Application for Renewal of Licensure from Pippin. 7 2. During the l996-97 school year, Pippin was employed as 8 a teacher at Eddyville School in the Lincoln County School 9 District (the "District"). 10 3. In December 1997, the District notified Pippin that it 11 did not have a copy of his current license on file and asked him 12 to forward a copy of his license. Pippin faxed a copy of his 13 license to the District. .14 4. When reviewing the license, the District noticed that 15 the type and font style on the license was different. On 16 December 19, 1997, the District faxed a copy of Pippin’s license 17 to TSPC to verify authenticity. TSPC reported that the facsimile 18 provided by the District of Pippin’s license was fraudulent, and 19 confirmed that his license had expired on January 26, 1996. , 2O 5. The District conducted an investigation and ultimately 21 concluded that the license had been altered, and that Pippin had 22 been teaching without a valid license. 23 6. On December 22, 1997, Pippin resigned his teaching 24 position. 25 Pippin enters into this Stipulation of Facts with the 26 knowledge that TSPC will adopt an Order revoking his license PAGE 2 — STIPULATION OF FACTS AND ORDER OF REVOCATION OF RIGHT TO . Myton, E ecutive Secretary Date 13 Teacher Standards and Practices Commission ‘l4 CONCLUSIONS OF LAW 15 The conduct described in the Findings of Fact constitutes 16 gross neglect of duty as that term is defined under 17 ORS 342.175(1) and OAR 584-20~040(4), as Pippin was employed as a 18 teacher without a valid license. l9 OPINION 20 Regardless of how it occurred, Pippin is ultimately 21 responsible for ensuring that he has obtained and maintained a 22 valid license. He violated the law and the terms of his teaching 23 contract by not maintaining a current teaching license. The 24 Commission views this failing seriously and believes that his 25 actions are directly related to Pippin’s responsibilities to his 26 profession, employer and students. LICENSE REINSTATEMENT . 1 maintain a valid license, his classroom was disrupted by the need 2 to hire a substitute to finish out the school year. 3 Pippin will be eligible to reapply for an Oregon Teaching 4 License after a period of one year from the date of this Order. 5 If Pippin reapplies, in addition to all standard terms of 6 licensure, he shall document that he is a law-abiding citizen, 7 and that he can and has complied with OAR 584 chapter 20-— the 8 standards for competent and ethical performance by Oregon 9 educators.
