OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS 4 Licensure of ) AND ORDER OF PROBATION 5 JEFFRY ALAN DAVIS ) '6/ On March 7, 2003, the Teacher Standards and Practices Commission (Commission) 8 adopted a Stipulation of Facts, Order of Reprimand and Probation based upon an investigation 9 indicating that Jeffry Alan Davis (Davis) violated the Commission’s Standards by consuming 1O alcohol prior to attending a district sponsored event. The Order placed Mr. Davis on a four (4) 11 year probation with specific conditions including the requirement that Mr. Davis submit bi-annual 12 reports of compliance to the Executive Director of the Commission. 13 November 21, 2005, Mr. Davis submitted an application for a Continuing Administrator 14 License. A review of that application and Mr. Davis’ Iicensure file indicates that Mr. Davis failed 15 to comply with reporting requirements of that probation. ‘ After review of the facts in this matter, Mr. Davis and the Executive Director agree that 17 their respective interests, together with the public interest, are best served by a stipulation to 18 certain facts, and the continuance of probation for an additional two (2) years. 19 This Order sets forth the facts upon which the parties have agreed and the sanction to 20 be imposed. Mr. Davis stipulates that there are sufficient facts contained in the Commission's 21 files and records to support the findings of fact and conclusions of law set forth below. In 22 entering into this stipulation, Mr. Davis waives the right to a hearing to contest the findings of 23 fact, conclusion of law and order set forth below. Mr. Davis understands that the Commission 24 will continue the probation for two (2) additional years with specific conditions. 25 This stipulation is contingent upon approval and adoption of the Order by the 26 Commission. If the Commission does not adopt this Order, neither Mr. Davis nor the 27 Commission are bound by these Stipulations and Mr. Davis retains all rights to a hearing on the ‘ allegations. Mr. Davis 3 currently holds a Standard Administrative License valid May 21, 2001, through May 24, 2006, 4 with a Standard Administrator Endorsement. 5 2. Mr. Davis is employed by Colton School District. 6 3. Mr. Davis failed to submit to the Exective Director of the Commission reports of his 7 compliance with the treatment plan every six months during his probation beginning on March 7, 8 2003. Said reports were required on or before: September 7, 2003; March 7, 2004; 9 September 7, 2004; March 7, 2005; and September 7, 2005. 10 4. Mr. Davis has complied with all other specific terms and conditions of the Probation 11 adopted March 7, 2003 and is othenlvise in compliance. 12 IT IS SO STIPULATED: 13 13/.» (1/. it'd“, Aéézl/QQ — ‘ ngi'ma ’ l/v' ’ Date J 4&4214I/142-/.11_ /- F7041 16 Victoria vr-mrlain, Exec 've Director Date 17 CONCLUSION OF LAW 18 Jeffrgl Alan Davis violated OAR 584-020—0040(4)(k) by failing to complete the specific 19 conditions of the four year Probation (beginning March 7, 2003) requiring him to submit reports 20 of compliance to the Executive Director of the Commission every six months during the four 21 year period of probation. This violation constitutes Gross Neglect of Duty. The Commission's 22 authority to impose discipline in this matter is based upon ORS 342.175. 23 ORDER 24 The Commission adopts the above Stipulation of Facts and extends Mr. Davis’ Probation 25 for a period of two (2) years to commence January 27, 2006 subject to the following terms and 26 conditions: O Page 2 STIPULATION OF FACTS AND ORDER PROBATION-DAVIS, JEFFRY 1 1. Mr. Davis shall, at his own initiative and expense, continue to obtain treatment for his . alcohol dependency as recommended by his alcohol treatment provider and abstain from the 3 consumption of alcohol; 4 2. During the period of this probation, Mr. Davis shall submit to the Executive Director of 5 the Commission reports of his compliance with the aftercare treatment plan. Mr. Davis shall 6 provide these reports every six (6) months during his probation, on or before: June 27, 2006; 7 January 27, 2007; June 27, 2007; January 27, 2008; and 8 3. Mr. Davis shall comply with the Standards for Competent and Ethical Performance of 9 Oregon Educators under Oregon Administrative Rules Chapter 584, Division 020. 10 Violation of any of the terms or conditions of probation shall constitute an independent 11 basis for the Commission to revoke Mr. Davis’ teaching license or otherwise impose discipline, 12 after first providing Mr. Davis with notice and opportunity for hearing. 13 IT IS SO ORDERED this @ day of January 2006. .
