1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 1’ 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) SUSPENSION AND ORDER 5 SUSAN BORLAND WEISENSEE ) OF PROBATION s ) 8 On or about October 10, 2000, the Teacher Standards and Practices Commission 9 (Commission) received a report from John Miner, Director of Human Resources for Gresham- 10 Barlow School District indicating that Susan Borland Weisensee (Ms. Weisensee) violated 11 Standards on August 31, 2000, by appearing on duty under the influence of alcohol. Additional 12 information from the District indicates that Ms. Weisensee also appeared on duty under the 13 influence of alcohol on May 23, 2001. 14 After review of the matters alleged, Ms. Weisensee and the Commission agree that their 15 respective interests, together with the public interest, are best served by a stipulation to certain ‘16 facts and the imposition of a sixty (60) day suspension of Ms. Weisensee’ Teaching License. 17 The Commission will impose a period of four (4) years probation upon reinstatement of her 18 teaching license. This Order sets forth the facts upon which the parties have agreed and the 19 sanction to be imposed. In entering into this stipulation, Ms. Weisensee waives the right to a 20 hearing to contest the findings of fact, conclusion of law and order set forth below. Ms. 21 Weisensee understands that the probation and suspension wilI be subject to specific conditions. 22 STIPULATION OF FACTS 23 1. Susan Borland Weisensee holds a Standard Teaching License with Standard Language I 24 Arts, Standard Drama, Standard Speech, Basic Reading and Standard Handicapped I 25 Learner I Endorsements valid from January 2, 1997 through January 25, 2002. ‘ 26 2. Ms. Weisensee was employed by the Gresham-Barlow School District from September 1993 27 through June 15, 2001. She resigned on May 31, 2001, effective June 15, 2001. ‘ 28 3. On August 31, 2000, Ms. Weisensee reported for duty while under the influence of alcohol; 29 The Gresham-Barlow School District reprimanded Ms. Weisensee for her behavior. Ms. Weisensee participated in the CareMark Behavioral Health outpatient drug and alcohol 4 program from September 12, 2000, through November 27, 2000. She successfully 5 completed the program and participated in aftercare. 6 5. On May 23, 2001, Ms. Weisensee reported for duty while under the influence Of alcohol as 7 determined by random check as per her agreement with the District. On May 31, 2001, Ms. 8 Weisensee resigned her teaching position with Gresham-Barlow School District in lieu of 9 termination. 1O 6. On July 28, 2001, Ms. Weisensee was admitted to an Adventist Medical Center residential 11 alcohol treatment facility. She completed the residential program on August 10, 2001. 12 7. Ms. Weisensee recognizes that she has an alcohol abuse problem and has agreed to a plan 13 of treatment and aftercare as prescribed by her treatment provider. '14 Susan Borland Weisensee enters into this Stipulation of Facts with the knowledge that 15 the Teacher Standards and Practices Commission will suspend her Oregon Teaching License 16 for a period of sixty (60) days and upon reinstatement of the license shall place her on probation 17 for a period of four (4) years. This Stipulation is contingent upon approval and adoption of the 18 Order by the full Commission. if the Commission does not adopt this Order, neither Ms. 19 Weisensee nor the Commission are bound by these stipulations and Ms. Weisensee retains the 20 right to a hearing on the allegations. 21 IT IS SO STIPULATED: 22 23 WWW .gg w m g?) Page 2-STIPULATION OF FACTS, SUSPENSION AND ORDER OF PROBATION - WEISENSEE 1 CONCLUSIONS OF LAW . 2 Susan Borland Weisensee violated OAR 584-020-0040(4)(g) by appearing on duty while 3 under the influence of alcohol on August 31, 2000 and May 23, 2001, at Damascus Middle 4 School. 5 ORDER 6 The Commission adopts the above finding of fact and suspends the Oregon Teaching 7 License of Susan Borland Weisensee for a period of sixty (60) days commencing on the first 8 day of her admission into a residential alcohol treatment facility, July 28, 2001, followed by a 9 four year probation upon reinstatement of her teaching license. At the end of the suspension 10 period, Ms. Weisensee’ Teaching License shall be reinstated upon application as provided by 11 OAR 584-050-0015 and certification Of her completion of residential alcohol treatment and 12 participation in aftercare as prescribed in the treatment plan. 13 The terms of probation are as follows: '14 1. Ms. Weisensee shall, at her own initiative and expense, continue to obtain treatment 15 for her alcohol dependency as recommended by her alcohol treatment provider; 16 2. Ms. Weisensee shall provide the Executive Director with a copy of the treatment plan; 17 3. During the period of her suspension and probation, Ms. Weisensee shall comply with 18 the terms of the treatment plan; 19 4. During the period of her probation, Ms. Weisensee shall submit to the Executive ‘ 20 Director of the Commission reports of her compliance with the treatment plan. Ms. Weisensee 21 shall provide these reports monthly for the first six months Of her probation and quarterly for the 22 balance of her probation; 23 5. Ms. Weisensee shall comply with all Standards for Competent and Ethical 24 Performance under Chapter 584, Division 020; 25 If Ms. Weisensee does not comply with her treatment plan based on the reports of her .26 treatment provider or as Otherwise determined by the Executive Director she shall be in violation 27 Of the terms of this probation.
