5 ) ORDER OF REVOCATION
6 On December 2, 1997, the Teacher Standards and Practices
7 Commission (Commission) issued a Notice of Opportunity for
8 hearing to Romey Roy Armes in which the Commission proposed to
9 suspend or revoke the teaching license or impose other discipline
10 under ORS 342.177, based upon alleged misconduct, including
11 sexual contact with a student. Mr. Armes requested a hearing
12 through his attorney, Sean Lyell, on December 10, 1997.

13 The Commission and Mr. Armes have now reviewed the matters
. 14 alleged and have agreed that their respective interests, together
15 with the public interest are best served by a surrender of Mr.

16 Armes's teaching license and a stipulation to certain facts. In

17 entering this stipulation, Mr. Armes waives his right to a

18 hearing and understands that the Commission will accept the

19 surrender of his license and issue an order revoking the license.

20 STIPULATED FACTS

21 Mr. Armes agrees and stipulates to the following findings of

22 fact by the Commission:

23 1. Mr. Armes holds a standard teaching license with a

24 subject endorsement in music.

25 2. Mr. Armes was employed as a teacher with the Beaverton

26 School District from August 30, 1966 to April 30, 1997, when he
. resigned his position with the district.

' 1 3. During the 1972-73 school year, Mr. Armes had sexual
2 contact on more than one occasion with a female high school
3 student, which contact consisted of kissing, fondling and
4 touching the student's body in a sexual manner and causing the

ll CONCLUSIONS OF LAW AND ORDER
12 Based on the foregoing, the Commission finds that Mr.
13 Armes’s conduct consisted of gross neglect of duty in violation
. l4 of OAR 584-20-0040(4) (f). Sexual contact with a student almost
15 always serves as a basis for revocation of a teacher's license.
16 Although the misconduct in this case, occurred several years ago,
17 the Commission concludes that the conduct was sufficiently
18 serious to justify revocation.
19 The Commission accepts the surrender of the teaching license
20 of Romey Roy Armes and orders that Mr. Armes's Oregon Teaching
21 License shall be revoked on the effective date of this order.
