9 On September 9, 2004, the Teacher Standards and Practices Commission
10 (Commission) issued a Notice of Opportunity for Hearing to Kevin Michael Kayfes (Kayfes) in
11 which the Commission charged him with conviction of crimes listed in ORS 342.143(3). The
12 Notice was sent via U.S. First Class Mail and U.S. Certified Mail Receipt #7003 2260 0000 8922
13 8371 to the address obtained by the Commission. The certified mail receipt was signed by
14 K. Rigdon, agent for Coffee Creek Correctional Facility and returned to the Commission on
15 September 12, 2004, The Notice of Opportunity of Hearing, dated September 9, 2004, and
16 signed by Victoria Chamberlain, Executive Director, stated:
q “You, Kevin Michael Kayfes, are entitled to a hearing on the proposed action of
the Commission. If you want a hearing, you must file a written request for a
19 hearing with the Commission within 21 days of the date of this notice. Attached
20 to this notice is a copy of the procedures, right of representation and other rights
21 of parties relating to the conduct of a hearing as required under ORS
22 183.413(2)."

24 Mr. Kayfes did not request a hearing. The Commission, therefore, finds
25 Mr. Kayfes to be in default and enters the following findings of fact, conclusions of law
26 and order, based on the files and records of the Commission concerning this matter.
27 FINDINGS OF FACT
28 1. Mr. Kayfes holds a Standard Teaching License issued September 4, 2001,
29 valid until September 23, 2006.
30 2. Mr. Kayfes served as a teacher for the McMinnvilIe School District from August 26,
31 1997, to January 29, 2003.

.1 3. On August 24, 2004, Kevin Michael Kayfes was convicted of Rape III, ORS 163.355
2 (three counts), Sodomy Ill, ORS 163.385 (three counts) and Sexual Abuse Ill, ORS 163.415
3 (three counts) in the Circuit Court of the State of Oregon for the County of Yamhill.
4 CONCLUSIONS OF LAW
5 The crimes of Rape Ill as defined in ORS 163.355, Sodomy III as defined in ORS
6 163.385 and Sexual Abuse Ill as defined in ORS 163.415 are listed in ORS 342.143(3). The
7 Commission is required to revoke the Oregon Standard Teaching License issued to Kevin
8 Michael Kayfes and revoke his right to apply for a license pursuant to ORS 342.175(2).
9 ORDER
10 The Commission hereby revokes the Oregon Standard Teaching License issued to
11 Kevin Michael Kayfes and revokes his right to apply for a teaching license.
