1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) SURRENDER AND FINAL 5 ELIZABETH LUCINDA LOGAN ) ORDER OF REVOCATION 6 On or about February 23, 2007, the Teacher Standards and Practices Commission 7 (Commission) received a report from Jeremy Lyon, Superintendent, Hillsboro School District, 8 indicating that Logan was cited by Hillsboro Police for theft and computer crimes. 9 Ms. Logan has fully cooperated with the TSPC investigation. After review of the matters 10 alleged, Ms. Logan and the Commission agree that their respective interests, together with the 11 public interest, are best sewed by a stipulation to certain facts and a surrender of her teaching 12 license pursuant to OAR 584-050-0027. 13 Ms. Logan agrees that the Commission has the authority to investigate the allegations 14 against her, make findings of fact and conclusions of law. Ms. Logan understands that the 15 Commission will rely upon these findings to revoke her license and waives her right to appeal 16 the revocation of her license. 17 This document sets forth the facts upon which the parties have agreed and the 18 stipulated sanction to be imposed. Ms. Logan stipulates that the TSPC has the statutory 19 authority to rely upon these facts to support this order and she will not contest this order. 20 By signing below, Ms. Logan acknowledges, understands, stipulates, and agrees to the _ 21 following: (i) she has been fully advised of her rights to notice and a hearing to contest the 22 findings of fact, conclusions of law, and order set forth below, and fully and finally waives all 23 such rights and any rights to appeal or otherwise challenge this Stipulation of Facts, Surrender 24 and Final Order of Revocation (Stipulation and Final Order); (ii) this Stipulation and Final Order 25 is a public document and disclosed to the public upon request by the Commission; (iii) this 26 Stipulation and Final Order is contingent upon and subject to approval and adoption by the 27 Commission. If the Commission does not approve and adopt this Stipulation and Final Order, Page 1 STIPULATION OF FACTS, FINAL ORDER OF SURENDER AND REVOCATION - LOGAN 1 then neither Ms. Logan nor the Commission are bound by the terms herein; (iv) she has fully 2 read this Stipulation and Final Order, and understands it completely; (v) she voluntarily enters 3 into this Stipulation and Final Order and consents to issuance and entry of the Stipulated Final 4 Order below; (vi) she has consulted with an attorney regarding this Stipulation and Final Order 5 and has been fully advised with regard to her rights thereto, or waives any and all rights to 6 consult with an attorney prior to entering into this Stipulation and Final Order and issuance and I 7 entry of the Stipulated Final Order below. ‘ 8 STIPULATION OF FACTS 9 1. The Commission has licensed Ms. Logan since July 15, 1987. Ms. Logan holds a 10 Basic Teaching License with a Basic Elementary Endorsement, issued May 12, 2006, valid 11 through May 11, 2009. 12 2. Ms. Logan began employment with the Hillsboro School District in 1987 where she 13 taught first and second grade students. 14 3. On January 11, 2007, Ms. Logan offered a children’s coat for sale on the internet web 15 site eBay. Ms. Logan stated that she received the coat from the school custodian, which the 16 custodian denied to school authorities. 17 4. On January 12, 2007, following the posting of flyers around the school regarding a 18 student's lost coat, Ms. Logan utilized school district computers to communicate with a 19 colleague in an attempt to conduct a fictitious sale to remove Ms. Logan's attempted coat sale 20 from the eBay website. 21 5. On November 20, 2007 Ms. Logan was convicted of Attempted Theft and Theft 3, 22 both misdemeanors. Ms Logan was also convicted of the Unlawful Use of a Computer, a 23 felony. Ms. 12 Logan attempted to sell the item on eBay. This conduct constitutes Gross Neglect of Duty in 13 violation of OAR 584-020-0040(4)(o) as it incorporates OAR 584-020-0035(1)(c)(B) and OAR 14 58¢020-0040(4)(n) as it incorporates OAR 584-020-00. When confronted about this situation 15 Ms. Logan was untruthful to school officials regarding her involvement. This conduct constitutes 16 gross neglect of duty in violation of OAR 584-020-0040(4)(c) and OAR 584-020-0040(4)(n) as it 17 incorporates OAR 584-020-0010(5). Ms. Logan utilized district computers to communicate 18 with a colleague in an attempt to conduct a fictitious sale in order to remove Ms. Logan’s 19 attempted coat from the eBay website. This conduct constitutes gross neglect of duty in 20 violation of OAR 584-020-0040(4)(o) as it incorporates OAR 584-020-0035(2)(e) and OAR 584- 21 020-0035(3)(a). Ms. Logan was subsequently convicted of Attempted Theft and Theft 3, both 22 misdemeanors, and Unlawful Use of a Computer, a felony. This conduct constitutes Gross 23 Neglect of Duty in violation of OAR 584-020-0040(3)(a) and OAR 584»020-0040(40(o) as it 24 incorporates OAR 584-020-0035(3)(a).
