1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION . g 0F THE STATE OF OREGON g In the Matter of the ) 6 Teaching License of _ ) STIPULATION OF FACTS, 7 MARK RAYMOND ADAMSKI ) ORDER OF SUSPENSION AND 8 ) PROBATION 9 10 On or about December 12, 2001, the Teacher Standards and Practices 11 Commission (Commission) received a report from Bill Burnett, Superintendent, South 12 Umpqua School District, alleging that Mark Raymond Adamski (Adamski) failed to pass 13 a criminal check when applying for a nonschool bus vehicle license. 14 Mr. Adamski fully cooperated with the Commission's investigation. After review 15 of the facts in this matter, Mr. Adamski and the Executive Director agree that their 16 respective interests, together with the public interests, are best served by a stipulation .‘17 to certain facts and the imposition of 128 days suspension of his right to apply for a 18 teaching license followed by a probation of two (2) years. 19 , This Order sets forth the facts upon which the parties have agreed and the 20 sanction to be imposed. In entering into this stipulation, Mr. Adamski waives the right to 21 a hearing to contest the findings of fact, conclusion of law and order set forth below. Mr. 22 Adamski understands that the probation will be subject to specific conditions. 23 This stipulation is contingent upon approval and adoption of the Order by the 24 Commission. If the Commission does not adopt this Order, neither Mr. Adamski nor the 25 Commission are bound by these Stipulations and Mr. Adamski retains all rights to a 26 hearing on the allegations. ‘27 /// ., . On or about June 18, 1996, Mr. Adamski applied for and was issued a basic 4 Teaching License valid September 4, 1996, through July 27, 2000. 5 2. On February 8, 1999, Mr. Adamski was arrested for and charged with 6 Assault IV (Domestic Abuse) and Menacing upon his wife. On November 4, 1999, Mr. ‘ 7 Adamski plead guilty to Assault IV and Harassment and entered into a diversion 8 agreement in Douglas County Circuit Court. He was sentenced to 40 hours of 9 Community Service (concurrent) for each crime. The Judgement Order indicates that, 10 “Case is to be dismissed within 6 months if no further incidents. If defendant violates 11 order, plea(s) of guilty shall be entered. Mr. Adamski completed the required 12 community service hours. The charges were not formally dismissed until February 6, '13 2002. 14 3. In June of 2000, Mr. Adamski and the South Umpqua School District jointly 15 requested a one-year extension of his Basic Teaching License. Mr. Adamski signed 16 and submitted a C-1 Application for Educator License Form C-1 dated June 1,2000, in 17 support of this request. Mr. Adamski responded “no” to aII character questions. The 18 one-year extension of Mr. Adamski’s Basic Teaching License expired on July 27, 2001. 19 4. On October 12, 2001, Mr. Adamski was arrested for Assault IV - Domestic 20 Abuse upon his 16 year old step daughter. On January 11, 2002, Mr. Adamski entered 21 into a deferred adjudication agreement in the Municipal Court of the City of Roseburg, 22 pursuant to which he has agreed to: (a) complete a domestic violence risk assessment; 23 (b) complete the course of therapy recommended by the domestic violence risk '24 assessment provider; and (c) have no further arrests or problems with the victim for a Page 2 STIPULATION 0F FACTS, ORDER OF SUSPENSION AND PROBATION - ADAMSKI ' 1 period Of twelve months. Upon successful completion of these requirements, the Court 2 agrees to dismiss the matter without prejudice. 3 5. Mr. Adamski was employed by South Umpqua School District beginning in 4 September of 1999 until termination on January 8, 2002. Mr. Adamski served as a 5 classroom teacher for the District witho'ut proper Iicensure, beyond the 120-day grace 6 period, for 38 days. 7 6. Myton, Executiv Director Date 16 Teacher Standards and Practices Commission 17 CONCLUSION OF LAW 18 Mr. Adamski violated OAR 584-020-0040(4)(c) false statement on or about June 19 1, 2000, when he signed and submitted an Application for Educator License Form C-1 2O by responding "no" to character question 8. “An erroneous belief that a conviction has 21 been expunged, set aside or sealed, when in fact it has not, will be deemed a false 22 statement." Mr. Adamski violated OAR 584-020-0040(5)(c) and (e) as a result of his 23 behavior and subsequent plea of guilty on November 4, 1999 for Assault IV and 24 Harassment in Douglas County Circuit Court and for his behavior and pending 25 prosecution in Roseburg Municipal for Assault IV. Mr. Adamski violated OAR 584-050- '26 0030(1), serving without proper Iicensure, by teaching in the South Umpqua School Page 3 STIPULATION OF FACTS, ORDER OF SUSPENSION AND PROBATION - ADAMSKI . 1 District without a teaching license beginning in September of the 2001-2002 school year 2 and continuing until January 8, 2002. 3 ORDER 4 The Commission suspends the right of Mark Raymond Adamski to apply for an 5 Oregon Teaching License effective March 8, 2002, for a period of 128 days. At the end 6 of this suspension period, subsequent to July 15, 2002, Mr. Adamski’s teaching license 7 shall be reinstated providing he meet the following conditions: 8 1. Submit complete application with required supporting documentation as per 9 OAR 584-050-0015(3), including fees; and 1O 2. Submit documentation that he has undergone an evaluation/assessment for 11 domestic violence/anger management by a psychotherapist or medical professional .12 acceptable to the Commission. The evaluator shall submit a written report to the 13 commission attesting that (a) Mr. Adamski is fit to work with children and teenagers; and 14 (b) there is a high probability that he will not engage in similar inappropriate behavior. 15 Any costs associated with the assessment or treatment will be the responsibility of Mr. 16 Adamski. 17 Upon reinstatement of his teaching license, Mr. Adamski shall be placed on 18 probation by the Commission for a period of two (2) years subject to the following 19 conditions: 2O 1. Mr. Adamski shall substantially comply with any treatment or counseling as ' 21 recommended by the individual who completed the evaluation as described above. Mr. 22 Adamski shall provide the Commission with proof of successful completion of such .23 treatment or counseling; Page 4 STIPULATION OF FACTS, ORDER OF SUSPENSION AND PROBATION - ADAMSKI . 1 2. Mr. Adamski shall report in writing within ten days to the Executive Director of 2 the Commission any arrest or citation for any felony, misdemeanor, or major traffic 3 violation; and 4 3.
