” ‘ BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION OF THE STATE OF OREGON In the Matter of the ) Case No. 111012 Teaching License of ) JANELLE LYNN PIERSON ) STIPULATION OF FACTS, ) SURRENDER OF LICENSE AND ORDER OF REVOCATION _ On November 26, 2002, Mike Stout, Director of Human Resources, David Douglas School District, sent a report to the Teacher Standards and Practices Commission (Commission) indicating that Janelle Lynn Pierson may have violated Commission standards in connection with her relationship with a student attending the David Douglas High School. I ‘ On May 16, 2003, the Commission issued a Notice of Opportunity for Hearing to " , Ms. Pierson, and Ms. Pierson requested a hearing. After a review of the matters alleged, Ms. Pierson and the Commission have agreed that their respective interests, together with the public interest, are best served by a stipulation to certain facts and a surrender of Ms. Pierson’s Oregon Teaching License pursuant to OAR 584-050-0027. This order sets for the facts upon which the Commission and Ms. Pierson have agreed and the sanction to be imposed. In entering into this stipulation, Ms. Pierson waives her right to a hearing to contest the findings of ‘ fact and conclusions of law set forth below. Ms, Pierson also understands that the Commission will accept the surrender of herteaching license and revoke the license. This stipulation is contingent upon approval and adoption of the order by the Commission. STIPULATION OF FACTS? Ms. Pierson and the Commission stipulate to the fpllowing facts and agree that there is substantial evidence in the record to support these facts: 1. Ms. Pierson holds a standard Oregon TeacLing License with an endorsement in Language Arts. 2. Ms. Pierson was employed as an English teacher at the David Douglas High School from September 1991 until December 30, 2+02, when she resigned her position with the District, effective January 9, 2003. Ms. Pierson was on leave of absence with the District from September 2002 until the date of her resignation. 3. Between January 2002 and November 2002, Ms. Pierson had sexual t . contact with a male high school student who attended David Douglas High School. 4. Based on the above conduct, Ms. Pierson was charged with a crime and entered a plea of guilty t0 the crime of Official Miscondudit in the First Degree in Multnomah Circuit Court on April 28, 2003. As a part of the plea agreement, Ms. Pierson acknowledged that she had engaged in sexual relation with the student. Ms. Pierson’s behavior constituted gross neglect of duty in violation of OAR 584-020-0040(4)(f) and gross unfitness in violation of OAR 584-020-0040(5)(c). ORDER The Commission accepts the surrender of Ms. Pierson’s Standard Teaching License and hereby revokes Ms. Pierson’s Standard Teaching License. IT IS so ORDERED this [5' day of January 2004.
