J 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ‘ OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) ORDER OF SUSPENSION g JUDITH ANN HANSELL ) AND PROBATION 7 On or about April 18, 2003, the Teacher Standards and Practices Commission 8 (Commission) received a report from Mike Corley, Superintendent, Ciatskanie School District 9 indicating that Judith Ann Hansell (Hansell) provided alcoholic beverages to students in her 10 personal residence. 1 1 Ms. Hansell fully cooperated with the Commission’s investigation. After review of the 12 matters alleged, Ms. Hansell and the Commission agree that their respective interests, together 13 with the public interest, are best served by a stipulation to certain facts, a six (6) month 14 suspension of her teaching license and a four (4) year probation upon reinstatement of said Iicensure. ‘S This Order sets forth the facts upon which the parties have agreed and the sanction to 17 be imposed. Ms. Hansell stipulates that there are sufficient facts contained in the Commission’s 18 files and records to support the findings of fact and conclusions of law set forth below. ln i 19 entering into this stipulation, Ms. Hansell waives the right to a hearing to contest the findings of i 20 tact, conclusions of law and order set forth below. Ms. Hansell enters into this agreement with 21 the knowledge that the Commission will suspend her teaching license for six (6) months. Ms. 22 Hansell understands that the Commission will impose a tour (4) year probation with specific 23 conditions. 24 This stipulation is contingent upon approval and adoption of the Order by the 25 Commission. If the Commission does not adopt this Order, neither Ms. Hansell nor the 26 Commission are bound by these stipulations, and Ms. Hansell retains all rights to a hearing on ‘7 the allegations. Ms. Hansell holds a Standard Teaching License issued March 28, 2000, valid through 3 May 14, 2005, with a Standard Language Arts Endorsement. 4 2. Ms. Hansell was employed by Clatskanie School District as a teacher at Clatskanie 5 Middle/High School beginning in September of 2000. Mr. Hansell resigned her employment 6 with the District effective June 13, 2003. 7 3. On March 21, 2003, Ms. Hansell allowed students in her home to consume alcoholic 8 beverages. 9 4. On June 10, 2003, Judith Ann Hansell entered into a 12 month Deferred Sentencing 10 Agreement for Allowing Consumption of Alcohol by Minor in the Municipal Court of the City of 1 1 Clatskanie, Oregon. Ms. Hansell was ordered to pay a money judgment of $502. 12 5. Ms. Hansell accepts responsibility for her behavior and she is remorseful for allowing 13 students to consume alcoholic beverages in her home. Judith Ann Hansell violated OAR 584-020-0040(5)(e) when 23 she engaged in an act constituting criminal conduct, Allowing Consumption of Alcohol by Minor. 24 This misconduct constitutes Gross Unfitness. The Commission's authority to impose discipline 25 in this matter is based upon ORS 342.175. O Page 2 STIPULATION OF FACTS, ORDER OF SUSPENSION AND PROBATION - HANSELL ' 1 ORDER ‘ Based on the foregoing, Judith Ann Hansell’s Standard Teaching License is suspended 3 for a period of six (6) months effective on August 11, 2003. Prior to reinstatement of licensure 4 by the Commission: 5 1. Ms. Hansell shall, at her own expense, seek the assistance of a qualified counselor 6 approved in advance by the commission, regarding appropriate professional boundaries and 7 judgment. Such counseling shall include at least twelve (12) one-hour sessions. The 8 Commission will provide the counselor with a copy of this Order, the District's report to the 9 Commission and the police report in this matter. The counselor will provide the Commission 1O with a report of successful program completion. 11 2. Ms. Hansell shall submit a complete application and fees pursuant to OAR 12 584-050-0015(3). 13 Furthermore, the Commission imposes a four (4) year probation upon reinstatement of ' licensure subject to the following terms and conditions: I 15 1. Ms. Hansell shall comply with all Standards for Competent and Ethical Performance 16 of Oregon Educators pursuant to Oregon Administrative Rules, Chapter 584, Division 020. 17 2. Ms. Hansell shall provide information, as requested by the Commission, to verify that 18 she has complied with the conditions of probation, including a statement from any future 19 employing district that she has complied with the Standards for Competent and Ethical 20 Performance under Oregon Administrative Rules, Chapter 584, Division 020. 21 3. Ms. Hansell shall report in writing within ten days to the Executive Director of the 22 Commission any arrest or citation for any felony, misdemeanor, major traffic violation or 23 violation of criminal probation. 24 Violation of any term or condition of this probation may constitute an independent basis i 25 for the Commission to impose discipline, up to and including revocation of Ms. Hansell’s right to O Page 3 STIPULATION OF FACTS, ORDER OF SUSPENSION AND PROBATION - HANSELL ‘i 1 for a teaching license, subject to Ms. Hansell’s right to a hearing on the issue of whether she ' violated probation.
