BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION OF THE STATE OF OREGON In the Matter of the ) Case No. _____ Teaching License of ) JOHN ROBERT SHILLING ) STIPULATION, PUBLIC REPRIMAND ) AND ORDER OF PROBATION On April 2, 1997, the Teacher Standards and Practices Commission (Commission) issued a Notice of Opportunity For Hearing to John Robert Shilling (Mr. Shilling). Mr. Shilling requested a hearing to contest the allegations in the Notice. After a review of the matters alleged, the parties have agreed that their respective interests, together with the public interest, are best served by a stipulation to certain facts and the imposition of a public reprimand and period of probation x subject to certain conditions. This Agreement sets forth the R facts upon which the parties have agreed the sanction to be ‘ imposed and the Commission's order. § STIPULATED FACTS The Commission and Mr. Shilling stipulate that there is substantial evidence in the record to support the following findings of fact, and the Commission makes the following findings‘ of fact: l. Mr. Shilling holds a basic teaching certificate with endorsements in Biology, Chemistry, Physics and Advanced Mathematics. 2. Mr. Shilling was employed as a science teacher for the Oakridge Junior/Senior High School in Oakridge School District ‘ Page l — STIPULATION, PUBLIC REPRIMAND AND ORDER OF PROBATION from August 29, 1995 to April l5, 1996 at which time he resigned . from his position with the District. 3. During the period of his employment with the Oakridge School District, Mr. Shilling on more than two occasions made inappropriate statements and jokes concerning sexual topics to both boy and girl students at the Oakridge High School. Mr. Schilling made the statements both during class time and during non-class hours. ORDER Based on the above findings and conclusions, the Commission imposes a public reprimand, and this order shall serve as the public reprimand. The Commission also places Mr. Shilling on probation for a period of one year from the date of this order. The order of probation shall be subject to the following conditions: /// /// . Mr. Shilling shall comply with all standards for the v . competent and ethical performance of Oregon educators under OAR 584-Division 20. 2. Mr. Shilling shall not make statements, jokes or comments of a sexual nature to students during class time or during non-class hours. 3. Mr. Shilling shall obey all laws and conduct himself as a law abiding citizen. Violation of any of the conditions of probation shall constitute an independent basis for the Commission to revoke Mr. Shilling's probation or otherwise impose discipline, after first providing Mr. Shilling with a Notice and Opportunity for Hearing under the sole issue of whether or not he has violated probation.
