1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 431 In the Matter of the | . 5 Teaching License of | DEFAULT ORDER 6 VIRGINIA ANN STOLLINGS | OF REVOCATION Z I 9 10 On July 18, 2001, the Teacher Standards and Practices Commission issued a Notice 11 of Opportunity for Hearing to Virginia Ann Stollings, in which the Commission proposed to 12 suspend or revoke the teaching license of Virginia Stollings or otherwise impose discipline 13 under ORS 342.177. The notice was sent via U.S. First Class Mail and U.S. Certified Mail 14 Receipt #7000 0600 0023 8496 8009 at the address Ms. Stollings provided to the 15 Commission. The certified mail receipt was signed by Allen C. Stollings and returned to the 16 Commission on July 26, 2001. Virginia Stollings did not request a hearing. 17 18 The Notice of Opportunity for Hearing, signed by David V. Myton, Executive 19 Director, stated: 20 If a request for hearing is not received within this 21-day period, your right to 21 hearing shall be considered waived unless your failure to request a hearing was 22 beyond your reasonable control. If you do no request a hearing or if you fail to 23 appear at a hearing, the Commission will adopt an Order of Default which may 24 include the revocation or suspension of your license or other discipline. 25 26 Based on the foregoing, the Commission finds Virginia Ann Stollings in default and 27 such default is hereby entered. Based on the records and files of the Commission, the 28 Commission enters the following findings of fact and order. 29 30 FINDINGS OF FACT 3 l 32 l. Virginia Ann Stollings holds a Standard Teaching License with endorsements in 33 Standard Language Arts and Basic Journalism valid from November 4, 1996 through 34 November 21, 2001. Virginia Ann Stollings has been employed by the Medford School District at . 2 Hedrick Middle School since September 1986. On November 27, 2000, Stollings entered 3 into an Agreement with the Medford School District placing her on unpaid medical leave 4 through August 27, 2001. 5 3. During the academic years of 1999-2000 and prior to October 20, 2000, 6 Virginia Stollings removed items without permission from Hedrick Middle School 7 belonging to the district and staff members. 8 4. On or about October 18, 2000, Virginia Stollings removed a set of CDs without 9 permission from the Media Center at Hedrick Middle School. 10 5. On or about October 18, 2000, Virginia Stollings appeared on duty at Hedrick 11 Middle School while under the influence of alcohol. 12 13 CONCLUSIONS OF LAW l4 15 Virginia Ann Stollings’ actions constitute gross neglect of duty in violation of OAR 16 584-020-0035(3)(a), 584-020-0040(4)(g) and 584-020-0040(4)(o). . 17 18 ORDER 19 20 The Commission revokes the Oregon Standard Teaching License #245215, issued to 21 Virginia A.
