BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION OF THE STATE OF OREGON In the Matter of the ) Teaching License of ) DEFAULT ORDER DONALD LEE BALL ) REVOKING LICENSE ) I On 0r about March 24, 1997, the Teacher Standards and Practices Commission received information from Earl Fisher, Superintendent of Columbia School District, indicating that he had received correspondence from a former student alleging that Ball had sexually abused him during the years of 1963-69. On September 19, 1997, the Commission took action to charge Ball with violation of TSPC Standards. The Executive Director took action to notify Ball of intent to revoke his teaching license, and to inform him opportunity for hearing. The notice, dated September 25, 1997, and signed by David V. Myton, Executive Director was mailed by U.S. Certified Mail-Return Receipt Requested. The Certificate #P 196 857 297 was signed by Ball on September 26, 1997. Mr. Ball did not request a hearing. j FINDINGS OF FACT 1. Donald Lee Ball holds a Standard Teaching License endorsed in Elementary and valid from December 12, 1993 to December 7, 1998. 2. Donald Lee Ball sexually abused a student,lFred Korhonen, from age 11 to age 17 (1963 to 1969) in violation of OAR 584-20-040(4)(i). i ( 3. Donald Lee Ball violated OAR 584-20-040(4)(c) on 0r about March 9, 1971, when he “ answered "no" to question number "7" on his Application for an Oregon State Teaching Certificate: "Have you ever been released or requested to resign from any position for misconduct or unsatisfactory service?" 1 ULTIMATE FINDINGS OF FACT T Donald Lee Ball violated OAR 584-20-040(4)(t) by sexually abusing a student from 1963 to 1969, and 584-20-040(4)(c) in his failure to answer truthfully the character question on his application for renewal of his Oregon Teaching Certificate in March 1971 relating to resignation fiom any position for misconduct or unsatisfactory service. 1 CONCLUSIONS OF LAW Under ORS 342.175 the Commission shall establish Standards for Competent and Ethical Performance of Oregon Educators. Oregon Administrative Rules, Chapter 584, Division 20 establish these Standards.
