The Notice was sent via U.S. First 13 Class Mail and U.S. Certified Mail Receipt 7015 0640 0004 7539 7066 to the address on file 14 with the Commission. The Notice designated the Commission file as the record for purposes 15 of proving a prima facie case. The Certified Mail receipt was not returned t0 the 16 Commission. The first class mail was not returned to the Commission. The Notice 0f I 17 Opportunity of Hearing, dated May 31, 2016, and signed by Victoria Chamberlain, Executive 18 Director, stated: l9 “IF A REQUEST FOR HEARING IS NOT RECEIVED WITHIN THIS 60-DAY 20 PERIOD, YOUR RIGHT TO A HEARING SHALL BE CONSIDERED WAIVED 21 UNLESS YOUR FAILURE TO REQUEST A HEARING WAS BEYOND YOUR 22 REASONABLE CONTROL. IF YOU DO NOT REQUEST A HEARING OR IF YOU 23 FAIL TO APPEAR AT A HEARING, THE COMMISSION WILL ADOPT AN ORDER 24 OF DEFAULT WHICH MAY INCLUDE THE REVOCATION OR SUSPENSION OF 25 YOUR LICENSE OR OTHER DISCIPLINE.” 26 27 Campbell did not request a hearing. The Commission, therefore, finds Campbell t0 be in 28 default and enters the following findings of fact, conclusions of law, and final order, based 29 on the files and records of the Commission concerning this matter. 30 FINDINGS OF FACT 31 1. Campbell has been licensed by the Commission since September 21, 1989. Campbell 32 previously held a Basic Teaching License, with an endorsement in Basic Elementary 33 (016), valid from December 26, 2011, through May 29, 2014. Campbell’s license 34 would have originally expired on December 25, 2014; however, Campbell’s license 35 was suspended by default order on May 29, 2014, for a period of sixty (60) days. On May 29, 2014, the Commission suspended Campbell’s teaching license by 5 default order for conduct that occurred during the 2012-13 school year. The 6 Commission requires anyone whose license has been suspended to apply for 7 reinstatement. Campbell was eligible to apply for reinstatement approximately 45 8 days prior to the end of her suspension period to allow for processing time. 9 Campbell failed t0 apply for reinstatement from suspended status and as such 10 Campbell’s license remained suspended. On December 29, 2014, Campbell 11 submitted an application for renewal of her license. On February 25, 2015, the 12 Commission, after learning that Campbell had continued to teach on a suspended 13 license, referred her application t0 professional standards to conduct an 14 investigation. Investigation determined the following: 15 16 a. As part of Campbell’s application, she completed the required character 17 questions section of the application, answering “No” to all questions. This 18 included answering “N0” to question number four, “Have you ever had 19 any adverse action taken on a professional certificate, license, or charter 20 school registration?” Campbell also answered “N0” t0 question number 21 seven, “Have you ever been disciplined by any public agency responsible 22 for licensure of any kind, including but not limited to educational 23 licensure?” Investigation determined that Campbell sought and received 24 employment by both the La Grande and Union County School Districts as 25 a substitute teacher. On both Campbell’s applications for employment 26 Campbell errantly answered “No” t0 all their pre-employment character 27 questions in a manner similar to how Campbell responded to the 28 Commission’s character questions. 29 b.
