T i 1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ‘ OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) AND ORDER OF REVOCATION 5 BOYCE WILLIAMS ) OF RIGHT TO APPLY 6 On March 17, 2005, the Teacher Standards and Practices Commission (Commission) 7 received a report from R. Michael Carter, Superintendent, Rainier School District indicating that 8 the Columbia County Sheriffs Office was investigating Boyce Williams (Williams) for 9 inappropriate behavior with students. Superintendent Carter provided documents indicating that 1O Mr. Williams’ teaching license was revoked on January 21, 1993, by the Alaska State 11 Professional Teaching Practices Commission. 12 After review of the matters alleged, Mr. Williams and the Commission agree that their 13 respective interests, together with the public interest, are best served by a stipulation to certain 14 facts and revocation of his right to apply for a teaching license. This Order sets forth the facts upon which the parties have agreed and the sanction to ‘6 be imposed. Mr. Williams stipulates that there are sufficient facts contained in the 17 Commission's files and records to support the findings of fact and conclusions of law set forth 18 below. In entering into this stipulation, Mr. Williams waives the right to a hearing to contest the 19 finding of fact, conclusion of law and order set forth below. Mr. Williams understands that the 20 Commission will revoke his right to apply for a teaching license. 21 This stipulation is contingent upon approval and adoption of the Order by the 22 Commission. If the Commission does not adopt this Order, neither Mr. Williams nor the 23 Commission are bound by these Stipulations and Mr. Williams retains all rights to a hearing on 24 the allegations. 25 STIPULATION OF FACTS 26 1. On July 3, 1979, the Commission issued Mr. Williams a Basic Teaching License valid ‘ through January 10, 1981. On July 25, 1984, the Commission issued Mr. Williams a Substitute 28 Teaching License valid through January 10, 1988. On January 21, 1993, the Alaska State Professional Teaching Practices Commission ' revoked Mr. Williams’ teaching license for spanking five minor male students on the bare 3 buttocks. 4 3. On September 5, 1995, the Commission issued a Restricted Teaching License to 5 Mr. Williams, valid through January 10, 1997, to teach handicapped learners at Robert Farrell 6 High School. The Commission placed Mr. Williams on probation for four years with the 7 condition that he shall have no forcible physical contact with any student. 8 4. On July 25, 1996, the Commission renewed Mr. Williams Basic Teaching License 9 valid through January 10, 2000. Mr. Williams met the recent educational experience 1O requirement and added a Basic Elementary endorsement. 11 5. On May 15, 2000, the Commission renewed Mr. Williams Basic Teaching License 12 valid until May 15, 2001, based upon the progress of requirements to maintain his Special 13 Education endorsement. . 6. On September 13, 2001, the Commission reinstated Mr. Williams’ expired Basic 15 Teaching License endorsed in Basic Elementary and Basic Handicapped Learner. Said license 16 expired May 15, 2005. 17 7. Mr. Williams began teaching for Rainier School District in September of 1998. 18 Mr. Williams resigned his teaching position on April 8, 2005. 19 8. Mr. Williams failed to maintain appropriate student-teacher relationships and spanked 20 three male special education students attending Rainier High Schoct during the 2004-2905 21 school year. 22 9. On August 18, 2005, Mr. Williams pled guilty and was convicted of three counts of 23 ORS 166.065, Harassment “Touching the Intimate Parts of Another Person” in the Circuit Court 24 of the State of Oregon for the County of Columbia. The court sentenced Mr. Williams to five 25 years probation with an additional condition mandating that, “Defendant shall not teach, . counsel, coach and/or be a leader of any minor children unless he completes a psych-sexual 27 evaluation including a full disclosing polygraph that is approved by the Probation Officer. This misconduct constitutes Gross Neglect of Duty 13 under OAR amaze-0040(4)“). 14 Mr. Vlfilliams‘ conviction for Harassment “Touching the Intimate Parts of Another 15 Person”, ORS 166.065, constitutes Gross Unfitness pursuant to OAR 584-020-0040(5)(e) and . OAR 584-020-0040(5)(c).
