9 On or about May 1, 2002, the Teacher Standards and Practices Commission
10 (Commission) received a report from George D. Lanning, Superintendent, Amity School District
11 indicating that Steven Patrick Burt (Burt) was arrested on three charges of Sex Abuse in the
12 Third Degree. The Executive Director took action to notify Burt of intent to revoke his license, ‘
13 and to inform him of his opportunity for hearing. The notice was sent via U.S. First Class Mail
14 and U.S. Certified Mail Receipt 7000 0600 0023 8496 9532. The certified mail receipt was
15 signed and dated on July 26, 2002. The Notice of Opportunity of Hearing, dated July 24, 2002,
16 and signed by Victoria Chamberlain, Executive Director, stated:
' ‘ "You, Steven Patrick Burt, are entitled to a hearing on the proposed action of the
18 Commission. If you want a hearing, you must file a written request for a hearing
19 with the Commission within 21 days of the date of this notice. Attached to this
20 notice is a copy of the procedures, right of representation and other rights of
21 parties relating to the conduct of a hearing as required under ORS 183.413(2)."

23 Mr. Burt did not request a hearing. The Commission, therefore, finds Mr.
24 Burt to be in default and enters the following findings of fact, conclusions of law and
25 order, based on the files and records of the Commission concerning this matter.
26 FINDINGS 0F FACT , . 1
27 1. On July 13, 1999, the Commission issued a Basic Teaching License to Steven Patrick
28 Burt. The license expired on August 7, 2002.
29 2. On August 29, 2000, Amity School District hired Steven Patrick Burt to teach at the
30 High School. He resigned effective May 8, 2002.

'1 3. On June 27, 2002, Steven Patrick Burt was convicted of Sexual Abuse III, ORS
2 163.415, in the Circuit Court of the State oi Oregon for the County of Yamhill.
3 4. On June 27, 2002, Steven Patrick Burt was convicted of Sexual Abuse Ill, ORS
4 163.415, in the Circuit Court of the State of Oregon for the County of Multnomah.
5 5. The convictions listed above were the result of Mr. Burt's relationship with a
6 student attending Amity High School.
' 7 CONCLUSIONS OF LAW
8 The crime of Sex Abuse Ill, ORS 163.415, is listed in ORS 342.143(3). The Commission
9 is required to revoke Steven Patrick Burt's right to apply for licensure pursuant to ORS
10 342.175(2).
11 ORDER
12 The Commission hereby revokes Steven Patrick Burt's right to apply for a teaching
3 license.
