.1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON 3 In the Matter 0f the ) STIPULATION OF FACTS 4 Teaching License of ) AND 5 BLAIN JOSEPH WILLARD ) ORDER OF REPRIMAND 6 On or about March 22, 2004, the Teacher Standards and Practices Commission 7 (Commission) received an application for renewal of a Standard Teaching License from Blain 8 Joseph Willard. The Greater Albany School District submitted a PEER form indicating that 9 during the 2001-2002, 2002-2003, and 2003-2004 school years Willard served at the high 1O school level on a middle level license. 11 After review of the matters alleged, Mr. Willard and the Executive Director agree that 12 their respective interests, together with the public interest, are best served by a stipulation to 13 certain facts and a public reprimand. This Order sets forth the facts upon which the parties have agreed and the sanction to Q) be imposed. Mr. Willard stipulates that there are sufficient facts contained in the Commission's 16 files and records to support the findings of fact and conclusions of law set forth below. In 17 entering into this stipulation, Mr. Willard waives the right to a hearing to contest the findings of 18 fact, conclusion of law and order set forth below. 19 This stipulation is contingent upon approval and adoption of the Order by the 20 Commission. If the Commission does not adopt this Order, neither Mr. Willard nor the 21 Commission are bound by these Stipulations, and Mr. Willard retains all rights to a hearing on 22 the allegations. 23 STIPULATION OF FACTS 24 1. Mr. Willard has been employed as a teacher for Greater Albany School District since Q September of 2000. Mr. Willard taught at the middle school level during the 2000-2001 school 3 year. 4 3. At Mr. Willard‘s request, the Commission issued a Basic Teaching License to 5 Mr. Willard on April 3, 2001, with an authorization at the middle level grades (5-9), endorsed in 6 Basic Language Arts. The license expired on March 27, 2004. 7 4. Prior to the start 0f the 2001-2002 school year Mr. Willard requested a transfer to 8 another middle or high school in the District. He was assigned to the high school level and 9 accepted a position outside of his licensure. 1O 5. Mr. Willard served without proper licensure for the 2001-2002, 2002-2003, and 2003- 1 1 2004 school years. 12 CONCLUSION 0F LAW 3 Blain Joseph Willard served without proper licensure in violation of OAR 584-050- ‘ 0030(1) and OAR 584-020-0040(4)(c) during the 2001-2002, 2002-2003 and 2003-2004 school 15 years. This misconduct constitutes Gross Neglect of Duty. The Commission’s authority to 16 impose discipline in this matter is based upon ORS 342.175. 17 IT IS SO STIPULATED: 18 19 132m. NM 7'1‘!
