1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ‘ OF THE STATE OF OREGON 3 In the Matter of the ) STIPULATION OF FACTS, 4 Teaching License of ) ORDER OF REINSTATEMENT 5 ANGELO JAMES HONJAS ) AND PROBATION 6 On or about September 22, 2004, the Teacher Standards and Practices Commission 7 (Commission) received an application for reinstatement of a revoked Basic Teaching License 8 from Angelo James Honjas (Honjas). Mr. Honjas answered affirmatively to character questions 9 1, 3, 4, 5, 6, 7, 8 and 10. Mr. Honjas submitted a written explanation of his affirmative 1O responses, a personal affidavit, court records, medical records and letters of recommendation 11 sufficient to establish convincingly that the educator possesses all of the qualifications required 12 for renewal of reinstatement of a license. 13 After review 0f the matters alleged, Mr. Honjas and the Commission agree that their 14 respective interests, together with the public interest, are best served by a stipulation to certain ' facts and the imposition of a two year (2) probation. 16 This Order sets forth the facts upon which the parties have agreed and the sanction to 17 be imposed. Mr. Honjas stipulates that there are sufficient facts contained in the Commission's 18 files and records to support the findings of fact and conclusions of law set forth below. In 19 entering into this stipulation, Mr. Honjas waives the right to a hearing to contest the findings of 20 fact, conclusions of law and order set forth below. Mr. Honjas understands that the probation 21 with be subject to specific terms and conditions. 22 This stipulation is contingent upon approval and adoption of the Order by the 23 Commission. If the Commission does not adopt this Order, neither Mr. Honjas nor the 24 Commission are bound by these Stipulations and Mr. Honjas retains all rights to a hearing on 25 the allegations. 26 /// ‘ /// 28 /// 1 STIPULATION OF FACTS, ORDER OF REINSTATEMENT AND PROBATION - HONJAS 1 STIPULATION 0F FACTS ' 1. The Commission issued a Basic Teaching license to Mr. Honjas on June 6, 1987. 3 2. On May 2, 1991, the Commission denied Mr. Honjas’ application for renewal of 4 licensure based upon false statement regarding a conviction for DUII. On July 26, 1991, the 5 Commission entered into a settlement agreement with Mr. Honjas granting renewal of licensure 6 and placing Mr. Honjas on probation for one year. 7 3. On January 2, 1992, the Commission received a report from Portland Public Schools 8 indicating that Honjas was arrested in two separate alcohol related incidents involving 9 inappropriate sexual behavior in the company of adults. Mr. Honjas was not criminally 10 prosecuted in these incidents. The Commission charged Mr. Honjas with misconduct and 11 sought to impose further discipline upon Mr. Honjas for violation of probation. On March 19, 12 1993, at Mr. Honjas’ request, the Commission held a hearing in this matter. On April 7, 1993, 13 the Commission adopted an Order placing Mr. Honjas on probation, with specific terms and '- conditions, for four years. 15 4. On December 2, 1993, the Commission issued a Notice of Proposed Termination of 16 Probation and Revocation of Licensure based upon evidence that Mr. Honjas violated his 17 probation by consuming alcohol and operating a motor vehicle while under the influence of 18 alcohol. On February 8, 1994, the Commission adopted a Stipulation, Surrender of License and 19 Order revoking the licensure of Mr. Honjas. 2O 5. On January 28, 1999, Mr. Honjas applied to reinstate a revoked license. On 21 March 15, 1999, the Commission notified Mr. Honjas of denial of his application for 22 reinstatement based upon repeated criminal convictions involving alcohol. On September 20, 23 1999, at Mr. Honjas’ request, the Commission held a hearing. On September 20, 1999, the 24 Commission adopted an Order denying the application for reinstatement of a revoked license 25 /// ' /// 2 STIPULATION OF FACTS, ORDER OF REINSTATEMENT AND PROBATION - HONJAS 1 6. On September 22, 2004, Mr. Honjas applied for reinstatement of a revoked license. ' On January 13, 2005, the Commission reviewed the application materials Mr. Honjas submitted 3 in support of reinstatement. The Oregon Teaching License of Angelo James Honjas is hereby reinstated subject to 3 all standard terms and conditions. 4 Furthermore, the Commission imposes a two (2) year probation upon Mr. Honjas subject 5 to the following terms and conditions: 6 1. Mr. Honjas shall at his own initiative and expense, continue to obtain treatment for his 7 alcohol dependency as recommended by his alcohol treatment provider; 8 2. During the period of this probation, Mr. Honjas shall comply with the terms of his 9 aftercare plan and shall abstain from the consumption of alcohol; 10 3. During the period of his probation, Mr. Honjas shall submit to the Executive Director 11 of the Commission reports of his compliance with the treatment plan and this probation. 12 Mr. Honjas shall provide these reports every six (6) months during his probation, on or before: 13 September 11, 2005, March 11, 2006, September 11, 2006, and March 11, 2007; . 4. Mr. Honjas shall report in writing within ten days to the Executive Director of the 15 Commission any arrest or citation for any felony, misdemeanor, major traffic violation; and 16 5. Mr. Honjas shall comply with all Standards for Competent and Ethical Performance of 17 Oregon Educators under Oregon Administrative Rules Chapter 584, Division 020. 18 If Mr. Honjas does not comply with all terms and conditions of this probation, based on 19 the reports of his treatment provider or as otherwise determined by the Executive Director, he 20 shall be in violation of this probation.
