p BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION OF THE STATE OF OREGON In the Matter of the ) Teaching License of ) ) STIPULATION, PUBLIC PAUL WARSHAUER ) REPRIMAND AND ORDER OF ) PROBATION On March 19, 1998, the Teacher Standards and Practices Commission (Commission) issued an Notice of Opportunity for hearing to Paul Warshauer. Mr. Warshauer, through this attorney, requested a hearing to contest the allegations in the Notice. After a review of the matters alleged, the Commission and Mr. Warshauer have agreed that their respective interests are best served by a Stipulation to Certain Facts, a Public Reprimand and an Order of Probation. This Agreement sets forth the facts ( on which the parties have agreed, the sanction to be imposed and a,’ the Commission's Order. This Stipulation and Order is subject to review and approval by the full Commission. If the Commission fails to approve the Stipulation and Proposed Order as written, any waiver of rights by Mr. Warshauer is revoked and any statements contained in this Stipulation may not be used by the Commission or Mr. Warshauer for any reason. STIPULATED FACTS The Commission and Mr. Warshauer stipulate as follows: l. Mr. Warshauer holds an Oregon Emergency Teaching License with endorsements in basic language arts and basic drama. The Emergency License expires on August 26, 1998, and €.€ PAGE l — STIPULATION, PUBLIC REPRIMAND AND ORDER OR PROBATION . Mr. Warshauer has expressed an intent to apply for a Basic or Standard Teaching License within the 120 day grace/period under OAR 584-050-0040. 2. Mr. Warshauer was employed with the Las Virgenes Unified School District in Calabasas, California, for approximately 3 1/2 years. In the fall of 1989, the district placed Mr. Warshauer on administrative leave pending an investigation for misconduct. Mr. Warshauer was still on leave when he resigned his teaching position on February 13, 1990. 3. Mr. Warshauer denies the allegations that he engaged in ‘ misconduct while employed with the Las Virgenes Unified School District. 4. Prior to his resignation, Mr. Warshauer initiated a claim against the school district. Mr. Warshauer's resignation was part of a negotiated settlement with the district in which Mr. Warshauer received a cash payment in the amount Of $50,000. 5. Mr. Warshauer acknowledges that the Commission could find that the allegations of misconduct were unresolved at the time of his resignation. Myton, E ecutive Director Date Teacher Standards nd Practices Commission CONCLUSION OF LAW Mr. Warshauer violated OAR 584-020-O40(4)(c) by failing to disclose that he resigned from his position with the Las Virgenes School District while under investigation for misconduct. . ORDER Based on the foregoing stipulated facts, the Commission issues a public reprimand, and this order shall serve as the public reprimand. The Commission further orders that Mr. Warshauer be placed on probation to the Commission for a period of 18 months from the date of this Order and subject to the conditions of probation that he comply with all Standards for Competent and Ethical Performance of Oregon Educators under OAR 584, Division 20. Failure to comply with any condition of probation shall be a basis in itself for discipline, up to and including revocation of Mr. Warshauer's Oregon Teaching License, and subject to .
