1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION ' ' 2 OF THE STATE OF OREGON 3 4 In the Matter of the ) 5 Teaching License of ) DEFAULT ORDER 6 MARIE KAY KOLSATD ) SUSPENDING LICENSE 7 l 8 9 On February 9, 1999, the Teacher Standards and Practices Commission received a complaint 10 from Stephen B. Williams, Assistant Superintendent of Lebanon Community School District, 11 indicating that Marie Kolstad had violated her contract by failing to provide 60 days’ written 12 notice prior to resignation. On January 26, 1999, Ms. Kolstad submitted her resignation for l3 personal reasons without providing 6O days’ written notice. The district did not include the l4 Board‘s resolution to suspend Kolstad‘s license for the balance of the 1998-99 school year and 15 accept her resignation. The resolution was received by TSPC on March 19, 1999. 16 " 17 Under OAR 584-050—0020, the Commission informs the educator of intent to suspend the 18 license on the basis of such complaints. The Executive Director took action to notify Ms. 19 Kolstad of intent to suspend her Teaching License, and to inform Ms. Kolstad of her 20 opportunity for hearing by letter dated March 26, 1999. The letter was sent by Certified Mail- 21 Return Receipt Requested #P 412 422 583. TSPC received an e-mail correspondence from Kolstad dated 22 April 18, 1999 inquiring as to the length of time the Suspension of her license would remain on her record. She did 23 not request a hearing. 24 25 FINDINGS OF FACT 26 27 l. On or about September 30, 1998, Marie Kolstad signed an offer of Probationary . (. 28 Teacher's Contract, under terms and conditions of board policy and the applicable . 29 collective bargaining agreement with the Lebanon Community School District for the 30 1998-99 School year. 3 l 32 2. On January 25, 1999, Ms. Kolstad submitted a letter of resignation effective March 24, 33 1999, but requested that the district release her on February 6, 1999. The district 34 35 3. Meeting in regular session on March 15, 1999, the Lebanon Community School Board 36 took action to seek a suspension of Ms. Kolstad's teaching license for the balance of the 37 1998-99 school year and accept her resignation. 38 39 4. The Lebanon Community School District informed TSPC of this action by forwarding a 40 copy of the board‘s resolution, requesting the suspension of Marie Kolstad's Teaching 41 License. 42 43 ULTIMATE FINDINGS OF FACT 44 45 Marie Kolstad was offered and signed a Probationary Teacher‘s Contract for the 1998-99 school 46 year with the Lebanon Community School District on September 30, 1998. Ms Kolstad 47 submitted a letter of resignation, dated January 25, 1999. The letter stated her resignation 48 was effective March 24, 1999, but requested the district to release her on February 6. The 49 district informed Kolstad they would release her as soon as her position could be filled. The 50 district granted Kolstad leave from the position from January 25-29, but was expected to 51 return on February l, 1999. Kolstad did not return and failed to provide the district with 6O 52 days written notice and did not report for duty subsequent to resignation. 53 o PAGE 1—DEFAULT ORDER—MARIE KAY KOLSTAD 1 1 CONCLUSIONS OF LAW . i 2 i 3 ORS 342.553 requires the suspension of a license for the balance of the school year for failure l 4 to provide 6O days’ notice prior to resignation. If the charge of the contract violation is proven, 1 5 and justification for the contract violation is not satisfactory, the Commission is required to ‘ 6 suspend the license for the remainder of the school year.
