1 BEFORE THE TEACHER STANDARDS AND PRACTICES COMMISSION 2 OF THE STATE OF OREGON ' In the Matter of the ) DEFAULT ORDER OF 5 Teaching License of ) LICENSE REVOCATION AND 6 PAUL CLYDE LENZ ) REVOCATION OF RIGHT TO 7 ) APPLY FOR A LICENSE 8 9 On July 8, 2005, the Teacher Standards and Practices Commission (Commission) issued a 10 Notice of Opportunity for Hearing to Paul Clyde Lenz (Lenz) in which the Commission charged him 11 with conviction of a crime listed in ORS 342.143(3). The Notice was sent via U.S. First Class Mail and 12 U.S. Certified Mail Receipt #7005 0390 0000 5019 1738 to the address Mr. Lenz provided to the 13 Commission. The certified mail receipt was not returned to the Commission. The Notice of 14 Opportunity of Hearing, dated July 8, 2005, and signed by Victoria Chamberlain, Executive Director, 15 stated: 16 "You, Paul Clyde Lenz, are entitled to a hearing on the proposed action of the 17 Commission. It you want a hearing, you must file a written request for a hearing with 18 the Commission within 21 days of the date of this notice. Attached to this notice is a copy of the procedures, right of representation and other rights of parties relating to the . conduct of a hearing as required under ORS 183.413(2).” 21 22 Mr. Lenz did not request a hearing. The Commission, therefore, finds 23 Mr. Lenz to be in default and enters the following findings of fact, conclusions of law and order, 24 based on the files and records of the Commission concerning this matter. 25 FINDINGS OF FACT 26 1. Mr. Lenz has been licensed by the Commission since November 15, 1972. Mr. Lenz 27 currently holds a Substitute Teaching License issued December 17, 2002, valid until January 1, 2006, 28 with a Substitute Any Specialty endorsement. 29 2. Mr. Lenz served as a licensed substitute teacher for the Lincoln County School District 30 since 1988, until he was removed from the active substitute teacher list on June 9, 2005. 31 3. On May 25, 2005, in the Circuit Court of the State of Oregon for the County of Yamhill Paul 32 Clyde Lenz was convicted of Public lndecency, ORS 163.465. The court placed Mr. Lenz on supervised probation for a period oi 18 months with special ' conditions. 3 CONCLUSIONS OF LAW 4 Mr. Lenz’s conviction for Public lndecency, ORS 163.465 is listed in ORS 342.143(3). The 5 Commission is required to revoke the Oregon Substitute Teaching License issued to Paul Clyde Lenz 6 and revoke his right to apply tor a license pursuant to ORS 342.175(2).
