The Notice was sent via U.S. 11 First Class Mail and U.S. Certified Mail Receipt 7002 3150 0004 3439 2407 to the address 12 Mr. Wilson provided to the Commission on his application for licensure. The certified mail 13 receipt was signed and dated on August 16, 2003. The Notice of Opportunity of Hearing, dated 14 August 15, 2003, and signed by Victoria Chamberlain, Executive Director, stated‘. I 15 "You, Robert Richard Wilson, are entitled to a hearing on the proposed action of 16 the Commission. If you want a hearing, you must file a written request for a 17 hearing with the Commission within 21 days of the date of this notice. Attached to this notice is a copy of the procedures, right of representation and other rights of parties relating to the conduct of a hearing as required under ORS 0 183.413(2).” 21 22 Mr. Wilson did not request a hearing. The Commission, therefore, finds 23 Mr. Wilson to be in default and enters the following findings of fact, conclusions of law 24 and order, based on the files and records of the Commission concerning this matter. 25 FINDINGS OF FACT 26 1. Mr. Wilson holds a Standard Personnel Service License with a Standard Counselor 27 Endorsement issued April 1, 1999, valid until December 10, 2004, and a Standard Teaching 28 License with a Standard Music Endorsement issued February 3, 2000, valid until December 10, 29 2005. 30 2. On January 10, 2003, David Davis, Superintendent, Klamath County School District, . reported that Mr. Wilson chased a female student around his music room and spanked her on 3 the buttocks. During the District investigation it was determined that Mr. Wilson engaged in 4 similar behavior with another female student earlier in the school year. 5 4, On August 14, 2001, David Davis, Klamath County School District filed a report with 6 the Commission alleging that Mr. Wilson violated Standards. On October 11, 2002, the 7 Commission adopted a resolution stating there was insufficient cause to justify holding a ‘ 8 hearing. 9 CONCLUSIONS 0F LAW 10 Mr. Wilson's inappropriate physical contact with students constitutes Gross Neglect of 11 Duty in violation of OAR 584-020-0040(4)(f). This conduct constitutes Gross Neglect of Duty. 12 The Commission‘s authority to impose discipline in this matter is based upon ORS 342.175. 13 ORDER , .
