1 BEFORE THE TEACHERS AND STANDARDS AND PRACTICES COMMISSION - 2 OF THE STATE OF OREGON / 3 4 In the Matter of the ) STIPULATION OF FACTS 5 Teaching License of ) SUSPENSION AND ORDER 6 JEAN ANN SROBA ) OF PROBATION 1 ) 8 9 On or about September 25, 1997, the Teacher Standards and Practices Commission 10 (Commission) issued a Notice of Opportunity for Hearing to Jean Sroba (Sroba) in which the 11 Commission proposed to suspend or revoke her Oregon Teaching License or to impose other 12 discipline under ORS 342.177. I3 14 The Commission and Sroba have now reviewed the matters alleged and have agreed to the 15 following stipulation. In entering this stipulation Sroba waives her right to a hearing. This l6 agreement sets forth the facts Sroba will not contest, including the Commission Order of a four 17 month suspension of Sroba’s teaching license and for two years’ probation. l8 l9 STIPULATION 0F FACTS 20 21 1. Jean Ann Sroba holds a Standard Teaching License endorsed for elementary and valid 22 from July 16, 1996 to July 26, 2001. 23 24 2. Sroba was employed as an elementary teacher by Gresham-Barlow School District, on 25 May 30, 1997, Sroba consumed alcohol in her classroom during school contact hours. 26 27 3. The District began termination proceedings but Sroba and the district resolved the 28 matter by settlement. The settlement resulted in Sroba resigning her regular status ' 29 with the opportunity to return as a substitute teacher subject to a "last chance" 30 agreemenet. 3 l 32 4. As part of the last chance agreement with the district, Sroba participated in and 33 completed an alcohol treament program. 34 35 5. Sroba returned to work in 1997 as a substitute teacher pursuant to her agreement with 36 the district. 37 38 6. On December 12, 1997, Sroba reported to work under the influence of alcohol. 39 40 7. The district subsequently terminated her employment as a teacher. l 41 42 8. Sroba recognizes that she has the disease of dependence. She has been re-evaluated by 1 43 a treatment provider and has agreed to a plan for continuing treatment of her 44 alcoholism. 45 46 9. Sroba has supplied the initial treatment plan and has agreed to supply subsequent 47 treatment plans and reports. 48 PAGE 1—PROPOSED STIPULATION AND ORDER—JEAN ANN SROBA . 1 Jean Ann Sroba enters into this Stipulation of Facts with knowledge that the Teacher 2 Standards and Practices Commission will suspend her Oregon Standard Teaching License for a ’ 3 period of four months and upon reinstatement of the license shall place her on probation for a 4 period of two years. . This Stipulation is contingent upon approval and adoption of the Order 5 by the Commission. Myton, Exec tive Director Date 20 Teacher Standards and Practices Commission 21 22 23 CONCLUSIONS OF LAW 24 25 Under ORS 342.175 Sroba violated OAR 584-020-0040[4)(g) on May 30, 1997 by consuming an ’ 26 alcoholic bevarge in her classroom during school contact hours and on December 12, 1997 27 when she reported to work while under the influence of alcohol. 28 ' 29 ORDER 3O 31 The Commission adopts the above findings of fact and suspends the Oregon teaching license of 32 Sroba for four months commencing April 15, 1998 through August 15,1998. Thereafter, Sroba 33 will be on probation for two years, for the period August 16, 1998 through August 15, 2000, 34 pursuant to ORS 342.177(3)(b). 35 36 The terms of probation are as follows: 37 38 l) Sroba shall, at her own initiative and expense, obtain treatment for her alcohol 39 dependency. 40 41 2) Sroba shall provide the Executive Director with a copy of the treatment plan. 42 43 3) During the period of her suspension and probation, Sroba shall comply with the 44 terms of the treatment plan. 45 46 4) During the period of her probation, Sroba shall obtain from her treatment provider 47 reports of her compliance with the treatment plan, which she (or the provider) will 48 submit to the Executive Director of the Commission. Sroba shall provide these reports 49 monthly for the first six months of her probation (until February 15, 1999] and 50 quarterly for the balance of her probation. 51 52 5) If Sroba does not comply with her treatment plan based on the reports of her 53 treatment provider or as otherwise determined by the Executive Director she shall be in .54 violation of the terms of this probation.
